Report on the results of the assessment of corruption risks in the activities of the Ministry of Internal Affairs of Ukraine in 2022

In accordance with the second part of Article 19 of the Law of Ukraine “On Prevention of Corruption”, in implementation of the Resolution of the Minister of Internal Affairs of Ukraine dated November 15, 2021 to the report note of the Head of the Department for Prevention of Corruption dated November 12, 2021 No. 48482/18 “On Corruption Risk Assessment and Planning of Anti-Corruption Activities of the Subjects of the MM System Ministry of Internal Affairs for 2022” commission for assessing corruption risks and monitoring the implementation of the anti-corruption program of the Ministry of Internal Affairs (hereinafter — the commission) together with the Department for the Prevention of Corruption of the Ministry of Internal Affairs during November 2021 — February In 2022, conducted an assessment of corruption risks in the activities of the Ministry of Internal Affairs.

Information on the decision of the Minister of Internal Affairs of Ukraine to conduct a regular assessment of corruption risks in the activities of the Ministry of Internal Affairs

On November 18, 2021, it was posted in the “News” section of the main page of the official website of the Ministry of Internal Affairs.

In order to comprehensively and objectively address this issue in the process of assessing corruption risks in the activities of the Ministry of Internal Affairs, experts who are aware of the internal and external environment of the Ministry of Internal Affairs and have experience in its activities are involved.

In connection with organizational and staff changes in the apparatus of the Ministry of Internal Affairs of Ukraine, the order of the Ministry of Internal Affairs of Ukraine dated December 17, 2021 No. 954 updated the composition of the commission formed by the order of the Ministry of Internal Affairs of Ukraine No. 1 of January 04, 2017. The head of the commission is determined by the State Secretary of the Ministry of Internal Affairs.

The commission consists of 32 persons: representatives of structural divisions of the apparatus of the Ministry of Internal Affairs, the Main Service Center of the Ministry of Internal Affairs (interregional territorial body for the provision of services of the Ministry of Internal Affairs), the Expert Service of the Ministry of Internal Affairs, as well as representatives of the Consultative Mission of the European Union in Ukraine — O. Sologub, B. Hat.

Representatives of the State Research Institute of the Ministry of Internal Affairs and the National Academy of Internal Affairs, who provided the necessary information for the assessment of corruption risks, were also involved in the corruption risk assessment as experts.

Identification of corruption risks was carried out by research (analysis) of the external and internal environment of the Ministry of Internal Affairs in order to identify factors of corruption risks in the normative legal acts of the Ministry of Internal Affairs and organizational and managerial activities. In particular, carried out:

analysis of the normative acts of the Ministry of Internal Affairs on the identification of norms that promote/may contribute to the commission of a corruption offense or an offense related to corruption;

electronic anonymous survey of persons of the Ministry of Internal Affairs, the Central Committee of the Ministry of Internal Affairs, the National Guard of Ukraine, institutions, institutions, enterprises belonging to the sphere of management of the Ministry of Internal Affairs, and the public, in which 8010 people took part (the survey was conducted in November-December 2021);

an anonymous survey of persons (conducted by Kharkiv National University of Internal Affairs) on the presence of corruption risks in the activities of the Ministry, in which 23,840 police respondents took part (the survey was conducted in all regions of Ukraine, except the temporarily occupied territories, in September-October 2021);

sociological research on the topic: “Corruption risk assessment in the activities of the Ministry of Internal Affairs” (conducted by the Kyiv International Institute of Sociology with the assistance of the Consultative Mission of the European Union in Ukraine), which was attended in 2003 by persons (men and women aged 18 and over) from all over Ukraine (except the temporarily occupied territories).

The total number of respondents covered by the survey is 33,853 people.

Based on the results of the study of the internal and external environment of the Ministry of Internal Affairs, the commission, taking into account the results of the assessments of corruption risks in the activities of the Ministry of Internal Affairs in 2020-2021, identified an additional 12 areas of activity of the Ministry of Internal Affairs. However, only 8 areas of activity of the function were subject to corruption risk assessment in 2022:

management of the Ministry;

maintaining public security and order (including permitting activities);

management of material resources;

migration;

public procurement;

personnel management;

provision of educational services;

provision of medical services.

In accordance with the requirements of the Methodology for assessing corruption risks in the activities of the authorities, approved by the decision of the National Agency of December 02, 2016 No. 126, registered with the Ministry of Justice of Ukraine on December 28, 2016 under No. 1718/29848, and the Working Plan for the Evaluation of Corruption Risks in the Activities of the Ministry of Internal Affairs of Ukraine, approved appointed by the chairman of the commission for assessing corruption risks and monitoring the implementation of the anti-corruption program of the Ministry of Internal Affairs on December 29, 2021, the commission identified corruption risks in the above areas of activity of the Ministry of Internal Affairs, carried out their formal definition and carried out an assessment of the identified corruption risks.

Based on the results of the assessment of corruption risks in the activities of the Ministry of Internal Affairs, the following have been prepared:

description of identified corruption risks in the activities of the Ministry of Internal Affairs, corruption risk factors and possible consequences of a corruption offense or a corruption-related offense (Appendix 1);

proposals for measures to eliminate (reduce the level) of identified corruption risks, which are set out in the table of assessed corruption risks and measures to eliminate them (Annex 2).
