On issues of availability of places of economic activity for low-mobility groups of the population

The basis for the conclusion on the availability of places of economic activity for low-mobility groups of the population, in accordance with state building codes, rules and standards (DBN V.2. 2-40:2018 “Inclusiveness of buildings and structures. Basic Provisions”, approved by the order of the Ministry of Regional Development, Construction and Housing and Communal Services of Ukraine dated November 30, 2018 No. 327), may serve as documentary confirmation of a specialist in the field of technical inspection of buildings and structures (expert) who has the appropriate qualification certificate.

Such documentary confirmation is the report on the conduct of a technical examination for compliance with the norms of safe access of persons with disabilities and other low-mobility groups of the population to buildings and structures in which the service of customers of security services is carried out.

At the same time, the report indicates the date of its compilation, surname, first name, patronymic of the expert and registration data of his qualification certificate.

Information about experts included in the register of certified persons can be obtained, in particular, on the portal of the Unified State Electronic System in the field of construction (register of construction activities - certified persons - experts).

In accordance with paragraphs 3 and 4 of the License Conditions for the Conduct of Security Activities, approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 18, 2015 No. 960, the licensee is obliged to comply with the requirements of the License Terms, and the license applicant is obliged to comply with the License Terms. Security activities can be carried out throughout the territory of Ukraine by legal entities, as well as individuals - entrepreneurs on the basis of a license, if there is a material and technical base necessary for such activities, and subject to the fulfillment by such persons of organizational, personnel and technological requirements stipulated by these License Terms.

According to subclause 5 of paragraph 8 of the License Conditions, security entities are obliged to provide the necessary conditions for the accessibility of persons with disabilities and other low-mobility groups of the population to the places of their activities, in which the service of customers of security services is carried out.

Failure to provide the licensee in the places of conducting business activities, where he provides services to customers and consumers of security services, conditions for persons with disabilities and other low-mobility groups of the population is considered a violation of the License Terms.

For other places of protection activities of the licensee, such requirements are not mandatory and cannot be attributed to violations of the License Terms.
