Informing about the need for timely notification of changes and responsibility for non-compliance with this requirement

We draw the attention of all licensees that in accordance with subclause 2 of paragraph 7 of the License Conditions for the conduct of economic activities for the production and repair of non-military firearms and their ammunition, cold weapons, pneumatic weapons with a caliber of more than 4.5 millimeters and a bullet flight speed of more than 100 meters per second, trade in non-military firearms and their ammunition, cold weapons, pneumatic weapons of caliber over 4.5 millimeters and a bullet flight speed of more than 100 meters per second; production of special equipment, charged with substances of tear and irritant action, personal protection, active defense and their sale, approved by the Resolution of the Cabinet of Ministers of Ukraine dated December 02, 2015 No. 1000, the business entity (licensee) is obliged to notify the licensing authority about all changes in the data that have been specified in the application and the documents attached to the application, no later than one month from the date of occurrence of such changes.

According to subparagraph 2 of paragraph 7 of the License Conditions for the Conduct of Security Activities, approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 18, 2015 No. 960, the security entity is obliged to notify the licensing authority of all changes in the data specified in the application, documents and information attached to the application about obtaining a license.

In the event of a change in such data, the licensee shall, within one month from the day following the day of their occurrence, submit to the licensing authority a corresponding notice in writing or electronic form together with copies of documents confirming the said changes (except information about security personnel, about the availability of special means and response vehicles, the change of which is notified to the authority licensing quarterly until the 10th of the first month of the next quarter (as of the 1st day of such month).

It should be noted that according to the Law of Ukraine “On Licensing of Business Activities”, changing the name of the licensee, changing the location of the legal entity and/or the head of the business entity is not a basis for re-issuing a license for conducting security activities, as well as amending the order on issuing a license to carry out business activities Asian. Information about these changes is entered in the license case of the licensee and the register of business entities that have a license to carry out the relevant type of activity.

The provision by the licensee to the licensing authority of information about the change of owner of the subject of security activities by the requirements of special legislation on licensing is not provided.

Violation by the licensee of the deadline for notifying the licensing authority of the change in the information specified in the application and documents attached to the application for obtaining a license in accordance with part six of Article 164 of the Code of Ukraine on administrative offenses entails the imposition of a fine from two hundred and fifty to fifty one hundred non-taxable minimum incomes of citizens.

During the period of martial law or a state of war, as well as within three months after its completion, administrative and/or criminal liability is not applied to individuals, individual entrepreneurs, legal entities for failure to submit or late submission of reports and/or documents, the submission of which is required in accordance with the norms of the current legislation in documentary and/or or in electronic form (Art. 1 of the Law of Ukraine “On Protection of the Interests of Subjects of Reporting and Other Documents During the Period of Martial Law or State of War”).

At the same time, this law provides that within three months after the termination or abolition of martial law or the state of war, individuals - entrepreneurs, legal entities, except those endowed with budgetary powers in accordance with the law, are obliged to submit reports (documents) for the entire period of non-reporting or obligation to submit documents.
