Information reference on the state of implementation of the
Ministry of Internal Affairs of the principles of state anti-corruption policy in Ukraine
In order to comply with the requirements of the Resolution of the Cabinet of Ministers of Ukraine dated 04.09.2013 No. 706 and in connection with the reorganization in the Ministry of Internal Affairs in November 2015, an independent structural unit — the Department for the Prevention of Corruption and Lustration (hereinafter referred to as the Directorate), which is an authorized unit of the Ministry of Internal Affairs apparatus for prevention and detection, was established corruption.
The Order of the Ministry of Internal Affairs of 22.12.2015 No. 1613 approved the Regulation on Management, which is posted on the official website of the Ministry of Internal Affairs in the subheading “Normative and organizational and administrative documents of the Ministry of Internal Affairs on the prevention of corruption, methodical materials” of the heading “Prevention of corruption”.
In addition, the National Guard of Ukraine, the central executive bodies whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Internal Affairs (hereinafter referred to as the bodies controlled by the Minister), have also formed appropriate authorized units for the prevention and detection of corruption.
In accordance with paragraph 14 of Section II of the State Program on the Implementation of the Principles of State Anti-Corruption Policy in Ukraine (Anti-Corruption Strategy) for 2015-2017, approved by the Resolution of the Cabinet of Ministers of Ukraine No. 265 of April 29, 2015, Order of the Ministry of Internal Affairs of February 29, 2016 No. 142, the Anti-Corruption Program of the Ministry of Internal Affairs for 2016 was approved year, which is posted on the official website of the Ministry of Internal Affairs in the subsection “Anti-corruption program of the Ministry of Internal Affairs and information on the results of its implementation” of the heading “Prevention of Corruption”, and the composition of the Commission for Coordination and Monitoring of the Anti-Corruption Program has been approved. The anti-corruption program of the Ministry of Internal Affairs for 2016 identified 7 priority directions directed by the Ministry of Internal Affairs to implement in the field of anti-corruption policy:
creation of an effective mechanism to prevent and combat corruption;
implementation of anti-corruption policy in personnel management, ensuring the integrity of employees, forming a negative attitude towards corruption;
implementation of measures to comply with the requirements of financial control, prevention and settlement of conflicts of interest;
prevention of corruption in the field of public procurement;
Strengthening the efficiency of financial resources management, ensuring transparency of implementation of budget programs, development and maintenance of internal financial control system;
creation of conditions for reporting on the facts of violation of the requirements of anti-corruption legislation, providing assistance to persons reporting violations of the requirements of anti-corruption legislation;
ensuring openness and transparency, involvement of the public in the implementation of anti-corruption measures.
In addition, the National Guard of Ukraine (order of 22.03.2016 № 166), the National Police of Ukraine (order of 22.03.2016 № 166), the National Police of Ukraine (order of 22.03.2016 № 231), the State Border Service of Ukraine (order of 29.02.2016 № 981.0AG), the State Emergency Service of Ukraine (order from 01.0AH) were also agreed with the Ministry of Internal Affairs and approved 3.3.2016 № 96), the State Migration Service of Ukraine (order of 04.04.2016 № 56), which are posted on the official websites of the mentioned state bodies.
Order of the Ministry of Internal Affairs of 15.01.2016 No. 23 obliges the heads of all institutions, institutions and enterprises belonging to the sphere of management of the Ministry of Internal Affairs to develop, agree with the Ministry of Internal Affairs and approve their own anti-corruption programs. In order to ensure the implementation of this mandate, the Department for the Prevention of Corruption and Lustration of the Ministry of Internal Affairs has prepared methodological recommendations for the development of anti-corruption programs, which are posted in the subheading “Information and reference materials” of the heading “Prevention of corruption” of the official website of the Ministry of Internal Affairs. When coordinating the programs of subordinate institutions, the attention of their managers is drawn to the need to place these programs on their own official websites.
Within the framework of the implementation of anti-corruption policy in personnel management in order to reduce the likelihood of corruption manifestations in the activities of persons who will be appointed to positions related, in particular, to making management decisions, allocation of resources, procurement, provision of administrative services, etc., in the apparatus of the Ministry of Internal Affairs The issue of the list of positions with an increased risk of corruption in the apparatus of the Ministry of Internal Affairs, its territorial bodies, as well as in the bodies controlled by the Minister is being worked out. The specified list after approval by the Minister of the Interior will be submitted to the National Agency for the Prevention of Corruption for approval.
In the system of the Ministry of Internal Affairs, in order to ensure compliance with the requirements of financial control, prevention and settlement of conflicts of interest by employees of the Office, an information letter on the list of declaration subjects in the system of the Ministry of Internal Affairs prepared and sent to the subordinate institutions of the Ministry of Internal Affairs and bodies controlled by the Minister an information letter on the list of subjects of declaration in the system of the Ministry of Internal Affairs, explanatory measures were carried out compliance with the requirements for filling out declarations on property, income, expenses and liabilities of a financial nature, organized to fulfill the order of the Ministry of Internal Affairs management, as well as the requirements of anti-corruption legislation in part prevention and resolution of conflicts of interest. This explanation covers about:
400 employees of the Ministry of Internal Affairs;
1000 employees of the National Police, 70 employees of the Main Directorate of the National Police of Ukraine in the city. Kyiv and 40 employees of the Department of Economic Protection of the National Police of Ukraine;
200 employees of the Administration of the State Border Guard Service and 200 employees of personnel services of territorial bodies and educational institutions of the State Border Guard Service.
In compliance with part six of Article 12 of the Law of Ukraine “On Principles of Prevention and Counteraction of Corruption” and Order of the Ministry of Internal Affairs of 11.04.2016 No. 278, the Department checked the timeliness of submission of declarations on property, income, expenses and liabilities of a financial nature by the subjects of declaration of the apparatus of the Ministry of Internal Affairs, according to the results of which the fact Untimely submission of declarations by employees of the apparatus of the Ministry of Internal Affairs was not detected. Currently, in accordance with the order of the Deputy Minister — Head of Staff, the Office checks declarations for the presence of conflict of interests of the declaration subjects of the Ministry of Internal Affairs apparatus, territorial bodies and heads of institutions, institutions and enterprises belonging to the sphere of management of the Ministry of Internal Affairs.
In order to eliminate the prerequisites for committing corruption offenses during the implementation of administrative procedures in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated 28.10.2015 No. 889 “On the formation of territorial bodies for the provision of service services of the Ministry of Internal Affairs”, regional service centers for the provision of service services of the Ministry of Internal Affairs have been established in each region. Today there are 147 territorial service centers of the Ministry of Internal Affairs, which are part of 26 regional service centers of the Ministry of Internal Affairs, the activities of which are coordinated by the Main Service Center of the Ministry of Internal Affairs. In addition, measures are being taken to form mobile service centers of the Ministry of Internal Affairs, which will provide services in remote and mountainous areas of the country, as well as in areas where there are no territorial service centers of the Ministry of Internal Affairs.
In order to realize the powers of the Ministry of Internal Affairs in terms of ensuring the implementation of measures to prevent and combat corruption, to inform the public about its activities, to implement measures related to the involvement of the public in activities to prevent and combat corruption in the system of the Ministry of Internal Affairs on the official website of the Ministry of Internal Affairs in January of this year, the rubric was introduced “Prevention of corruption”, which contains the following subheadings: “Information and reference materials”, “Acts of anti-corruption legislation”, “Normative and organizational and administrative documents of the Ministry of Internal Affairs on the prevention of corruption, methodical materials”, “Contact information on anti-corruption units of bodies and institutions belonging to the sphere of the Ministry of Internal Affairs”, “Anti-corruption program of the Ministry of Internal Affairs and information on the results of its implementation”, “Statistics”, “Feedback”, “Surveys” (subheading in the process of elaboration). The order of the Minister of Internal Affairs dated 19.02.2016 obliges the National Guard and the bodies under the control of the Minister to form (in case of formation, bring it into line with the proposed structure) similar headings on the main page of the official website of the relevant body.
The official website of the National Guard of Ukraine has a trust phone number, online consultations are provided, the section “Prevention of corruption” has been created, where, in particular, the subheadings “Anti-corruption measures”, “Contacts”, “Report corruption” are introduced.
The National Police of Ukraine has opened a SLL center at the phone number 0-800-50-02-02.
Currently, citizens from all regions of the state will be able to report illegal actions of police officers; find out about the progress of consideration of submitted applications; receive background information. The SLL center is open 24 hours a day.
The State Emergency Service and its territorial units provide an opportunity to make reports of corruption, in particular through special telephone lines, official websites, and electronic means of communication.
In order to realize the right of citizens of Ukraine, foreigners and stateless persons to make proposals for improving the activity of the State Tax Service of Ukraine, to expose shortcomings in work and to challenge the actions of officials, in territorial units on stands with consultative and reference information are posted information about communication channels with the sector of prevention and detection DMS reforms, in particular in Ukrainian, Russian and English.
It is also possible to make reports of corruption by mail or in person (orally) during the personal reception of citizens according to the schedule of the Reception of Citizens of the DMS, according to the schedule of personal reception of citizens by the DMS management at the address: 01001, m. Kyiv, str. Vladimirskaya, 9, at the telephone number “hotline” of the DMS (044) 278-50-30, through the Skype social application and to the e-mail: [email protected]. This information is posted on the official website of the DMS and the official websites of the territorial bodies of the DMS. The Order of the Head of the State DMS dated 04.04.2016
№ D/62/1-16 instructed the heads of the GUDMS, UDMS in the regions and the city of Kyiv to bring to the attention of all SMS employees information about the implementation of the e-mail box [email protected] in the DMS apparatus, to which the employees will be able to inform about facts of illegal registration of passports of a citizen of Ukraine, a passport of a citizen of Ukraine for traveling abroad or documenting foreigners, other violations of current legislation.
The State Border Guard Service of Ukraine has created mechanisms for submitting applications of citizens, including anonymous messages received by electronic means, as well as on the telephone of the Dovira departmental service. For reports on the facts of violation of the requirements of anti-corruption legislation, provision of assistance.
On April 7, 2016, a meeting of the commission was held, which considered the state of implementation of the Anti-Corruption Program of the Ministry of Internal Affairs for 2016 in the first quarter of the current year. The members of the commission approved information on the state of implementation of the Ministry of Internal Affairs
in the first quarter of 2016 of the measures of the specified State Program, which was sent to the Ministry of Justice by letter dated 15.04.2016 No. 5747/05/18-2016. In general, the state of implementation in the first quarter of the current year of the Anti-Corruption Program of the Ministry of Internal Affairs for 2016 was considered satisfactory by the members of the Commission for Coordination and Monitoring of the Anti-Corruption Program.
