“On the approval of the criteria by which the degree of risk is assessed
from the conduct of economic activities in the field of security activities,
which is subject to licensing, and determines the frequency of carrying out planned measures of state supervision (control) by the Ministry of Internal Affairs of Ukraine” and analysis of its regulatory impact
In accordance with Articles 9, 13 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity” (hereinafter referred to as the Law), in order to receive comments and proposals from individuals and legal entities, their associations are published:
draft resolution of the Cabinet of Ministers of Ukraine “On approval of the criteria by which the degree of risk from the conduct of economic activities in the field of security activities subject to licensing is determined and the frequency of carrying out planned state supervision (control) measures by the Ministry of Internal Affairs of Ukraine” (hereinafter — the draft) and analysis its regulatory influence.
The developer is the Ministry of Internal Affairs of Ukraine.
The draft is designed to comply with the requirements of the second part of Article 5 of the Law of Ukraine “On the Basic Principles of State Supervision (Control) in the Field of Economic Activity”, the decision of the Government Committee on Economic, Financial and Legal Policy, Development of the Fuel and Energy Complex, Infrastructure, Defense and Law Enforcement Activities dated 24.05.2018 (item 2 of question 25 Protocol No. 20) on ensuring that state supervision (control) bodies bring regulations regarding the approval of criteria by which the degree of risk from the proceedings is assessed economic activities and determines the frequency of carrying out planned measures of state supervision (control), in accordance with the requirements of the Resolution of the Cabinet of Ministers of Ukraine dated May 10, 2018 No. 342 “On approval of methods for the development of criteria by which the degree of risk from the conduct of economic activities is assessed and the frequency of carrying out planned state activities is determined supervision (control), as well as unified forms of acts drawn up on the results of planned (unplanned) measures of state supervision (control)”.
The adoption of the regulatory act will contribute to the introduction of a risk-oriented approach to the implementation of state supervision (control) measures in the field of security activities, the establishment of clearer requirements for the assessment and determination of the degree of risk from the conduct of such activities, which will ensure the optimal redistribution of the attention of the state supervisory body (control) from less risky subjects acts of security activities on more risky ones.
