Draft Order of the Ministry of Internal Affairs of Ukraine “On Approval of the List of Requirements for Institutions Carrying Out Training, Retraining and Retraining of Vehicle Drivers, and Qualification Requirements for Specialists Carrying Out Such Training”

In accordance with Articles 9, 13 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity” (hereinafter — the Law), we announce the publication on September 26, 2023 on the official website of the Ministry of Internal Affairs of Ukraine (hereinafter — the Ministry of Internal Affairs) of the draft order of the Ministry of Internal Affairs “On Approval of the List of Requirements for Institutions carry out training, retraining and further training of drivers of vehicles, and qualification requirements for specialists who carry out such training” (hereinafter referred to as the draft order): https://mvs.gov.ua/normativna-baza-mvs/proekti-normativnix-aktiv/povidomlennia-pro-opriliudnennia-projektu-nakazu-ministerstva-vnutrisnix-sprav-ukrayini-pro-zatverdzennia-pereliku-vimog-do-zakladiv-shho-provodiat-pidgotovku-perepidgotovku-i-pidvishhennia-kvalifikaciyi-vodiyi.

On July 29, 2023, the Law of Ukraine of July 13, 2023 No. 3234-IX “On Amendments to the Code of Ukraine on Administrative Offenses on the Introduction of Administrative Responsibility in the Field of Training and Admission of Drivers to Drive Vehicles” (hereinafter referred to as the Law) entered into force.

Paragraph 3 of Section II “Final Provisions” of the Law provides, within a period of three months from the date of entry into force of this Law, to ensure, in particular, the adoption and bringing by ministries and other central executive bodies their regulations in accordance with this Law.

Thus, paragraph 2 of Chapter II “Final Provisions” of the Law amended Article 15 of the Law of Ukraine “On Road Traffic”, which amended the requirement to determine by a joint act of the Ministry of Internal Affairs, the central executive bodies that ensure the formation of state policy in the fields of education and science, transport and labor protection, the list of requirements for institutions institutions that train, retrain and improve the qualifications of drivers of vehicles (hereinafter — training establishments), qualification requirements for specialists of institutions that carry out such training.

In accordance with the adopted amendments, the list of requirements for training institutions, qualification requirements for specialists who carry out such training are determined by the Ministry of Internal Affairs in coordination with the central executive bodies that ensure the formation of state policy in the fields of education and science, transport and labor protection.

In this regard, the Ministry of Internal Affairs has developed a draft order, which defines a list of requirements for training institutions, qualification requirements for specialists who carry out such training.
