In accordance with Articles 9, 13 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity” (hereinafter referred to as the Law), in order to receive comments and proposals from individuals and legal entities, their associations are published:
draft resolution of the Cabinet of Ministers of Ukraine “On Amendments to the License Conditions for the Conduct of Security Activities, License Conditions for the Conduct of Economic Activities for the Production and Repair of Non-Military Firearms and Ammunition for It, Cold Weapons, Pneumatic Weapons Caliber Over 4.5 Millimeters and the flight of a bullet over 100 meters per second, trade in non-military firearms and ammunition therefor, cold weapons, pneumatic weapons of caliber over 4.5 millimeters and a bullet flight speed of more than 100 meters per second; production of special devices charged with tear and irritant substances, personal protection, active defense and their sale” (hereinafter referred to as the draft) and analysis of its regulatory impact.
The developer is the Ministry of Internal Affairs of Ukraine.
The project was developed in order to bring the licensing conditions for the conduct of economic activities, the licensing body of which is the Ministry of Internal Affairs, in accordance with the laws of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on the Use of Seals by Legal Entities and Individual Entrepreneurs” and “On Licensing of Business Activities”, definitions of clear, understandable clear and unambiguous regulations on the storage, accounting of receipt, manufacture, sale of weapons, ammunition for it and special means, taking into account the peculiarity of their purpose, as well as preventing the occurrence of negative consequences from the conduct of economic activities.
The draft provides for amendments to the license terms in terms of the exclusion of requirements for certification of copies of documents with seals; approval of new samples of applications for licenses; replacement of the “certificate of conformity” with “document of conformity”; exclusion of certain requirements for equipment with alarms of premises located on closed facilities; establishment of accessibility requirements for persons with disabilities to places of service provision by business entities.
