Checks of compliance with quarantine rules and COVID documentation are carried out legally - Igor Klymenko

The right of the police to conduct quarantine raids and check this category of documents is provided for by the relevant Government Decree and the Laws of Ukraine. In addition, such functions do not contradict the provisions of the Constitution of Ukraine. The head of the National Police of Ukraine told about this today, November 8, in the paperback edition “Censor”.

According to Igor Klymenko, active discussions are currently underway on the legitimacy of police actions when checking COVID documentation and on conducting quarantine raids in general. At the same time, the head of the National Police noted that police officers are not only guided by the relevant Government decree, but also act in accordance with the provisions of the Constitution of Ukraine.

“In fact, from the beginning of the introduction of quarantine, we hear accusations about the alleged lack of legitimacy of the powers of the police to check and monitor compliance with quarantine restrictions. Let me remind you that they are currently established by the Resolution of the Cabinet of Ministers No. 1236. And Article 117 of the Constitution of Ukraine stipulates that the resolutions and orders of the Cabinet of Ministers are mandatory for implementation,” Ihor Klymenko stressed.

He added that by decree No. 1236, police officers are authorized to conduct selective checks of documents confirming COVID safety. This category includes, in particular, vaccination certificates. It is important that vaccination documents do not reflect the state of human health. We are talking only about the fact of receiving or not receiving the vaccine, therefore, when reading the data, the police do not receive any information about the state of health of the person.

“There is only confirmation of the fact that the person has been vaccinated. And, accordingly, may not take into account the prohibitions that are provided for the unvaccinated. I consider all claims of human rights violations during these inspections to be blatant manipulation,” the head of the National Police said.

He also noted that when checking COVID documentation, law enforcement officers act within the framework of the legislation, as they comply with the requirements of the laws of Ukraine “On Protection of the Population from Infectious Diseases”, “On the National Police”, as well as the Cabinet of Ministers of Ukraine Resolution No. 1236. In particular, for violation of the rules of quarantine, there is both administrative and criminal liability. And in accordance with Article 23 of the Law of Ukraine “On the National Police”, police officers warn, detect and stop criminal and administrative offenses.

“I hope that on this topic regarding the powers of the police during the checks of compliance with the quarantine rules will be closed. To summarize: checks of compliance with quarantine rules and COVID documentation are carried out in a legal way,” Igor Klymenko stressed.
