The Supreme Court of Cassation of Rome has finally confirmed the victory of Ukraine in the case of guard Vitaliy Markiv

Today, December 9, the Supreme Court of Cassation of Rome, the third and highest instance, rejected all the pleas of the prosecution party and upheld the acquittal of the court of appeal for Ukrainian guard Vitaliy Markiv.

“The Markov case has come to an end. All claims are rejected. The decision of the Milan court has been upheld,” he said.

All claims against the state of Ukraine have also been removed.

“Today is the end! We won in the Cassation Decision!!!! All claims were dismissed. Thank you very much to everyone involved!!!! This is our joint victory. Truth always wins,” Vitaly Markov wrote on his social network.

Recall that on June 30, 2017, a senior sergeant of the detachment battalion named after him was detained in Italy. The guard unit then did not have heavy weapons, namely mortars, with the fire of which could have killed the injured foreign photographer, and he himself was in the positions of militants of pro-Russian illegal armed groups and deliberately put himself in danger, despite the official warnings of the Italian embassy not to go to the combat zone.

On July 12, 2019, the court of the city of Pavia passed a verdict in the case of the Ukrainian guard Vitaliy Markiv. By a court decision, the guard was sentenced to 24 years in prison. On July 12, 2019, Arsen Avakov announced that Ukraine will appeal the shameful sentence of the Italian court - 24 years of imprisonment of Vitaly Markov.

Senior Sergeant of the National Guard of Ukraine Vitaliy Markiv was serving his sentence in a prison near Milan. He has been in custody since his arrest in Bologna on June 30, 2017.

In August 2020, the National Police of Ukraine, as part of the investigation of criminal proceedings on the death of Italian photojournalist Andrea Rockelli and citizen of the Russian Federation Andrei Mironov, conducted a number of investigative actions at the scene, in Slavyansk and on Mount Karachun and received non-evidence guilt of Vitaly Markov.

The first hearing of the Court of Appeal in the Vitali Markiv case took place in Milan on September 29, 2020. The defense, led by top Italian lawyers Raffaelli Della Valle and Niccolo Bertolini Clerici, insists on the innocence of Vitali Markiv, who could not have been involved in the death of Andrea Rokelli.

On October 1, 2020, another appeal hearing was held in Milan in the case of National Guardsman Vitaliy Markiv. The Ukrainian side once again stressed that the decision of the court of first instance on the Markov case is absurd and we are counting on the incorporation of the materials of the Ukrainian side into the case.

On October 23, 2020, the Court of Appeal on the case of the National Guard resumed in Milan. At the hearing, the defense presented to the jury the facts indicating that Vitali was not involved in the death of Italian journalist Andrea Rocelli.

Already on November 3, 2020, Vitaly Markov made his final statement in court, in which he stressed his innocence and complete non-involvement in the death of Italian reporter Andrea Rockelli and his translator, Russian human rights activist Andrei Mironov. The soldier asked the court to analyze facts, not fiction.
