Investigators sent to court the case of an official who unlawfully removed the arrest from the property of a non-payer of alimony
This allowed the malicious defaulter of alimony, who owed about 170 thousand hryvnias to pay for the maintenance and education of the child, to alienate the land plot. On June 17, with the indictment, the materials of the case, the defendant of which is a 37-year-old state executor, are sent to the court.
According to the deputy head of the GUNP in the Vinnytsia region Alexander Soldatov, in July last year, the chief state executor of one of the city's executive departments opened an enforcement proceeding to collect alimony from the debtor for the maintenance of an adult child who continues to study at a university. In connection with the indebtedness of the defaulter, alimony was entered into the Unified Register of Debtors and a seizure was imposed on his property - an apartment and a land plot.
In September last year, the official, knowing that the debt was not repaid, having access to information that is processed in the automated system of the Unified State Register of Enforcement Proceedings, without having legal grounds, changed an electronic document with knowingly false data on the absence of debt. This enabled the non-payer of alimony on the same day to alienate the land in favor of his mother. After this transfer, the official again changed the electronic record indicating the arrears of the alimony arrears.
On May 31, 2021, the investigators of the regional head of police of Vinnytsia region announced to the state executor about the suspicion of committing the crime stipulated in Part 1 of Art. 362 of the Criminal Code of Ukraine (unauthorized actions with information that is processed in electronic computers (computers), automated systems, computer networks or stored on the media of such information, committed by a person who has the right to access that information).
The pre-trial investigation of this criminal proceedings has been completed and today, June 17, with the indictment sent to the court. The official faces a fine of up to four thousand non-taxable minimum incomes of citizens or correctional work for up to 2 years.
