On refusal to issue a license to conduct security activities

An individual — entrepreneur SIDAK IVAN SERHIYOVYCH (hereinafter — the license applicant) applied to the Ministry of Internal Affairs of Ukraine for the issuance of a license to conduct security activities.

According to the results of consideration of the application and the submitted documents, it is established that the employment contract concluded by the license applicant with an employee who is entrusted with the performance of the duties of a specialist in the organization of security measures (hereinafter referred to as a specialist) indicates a position that does not meet the requirements of Article 1 of the Law of Ukraine “On Security Activities”, since a specialist in organization security guards are the head of the security entity or his deputy, the head of a branch, another separate structural unit or his deputy, whose official duties include organization and conduct of security measures, control over the performance by the security personnel of the duties assigned to it.

In addition, the entries in the work book of a specialist do not confirm his qualification, defined by paragraph 14 of the License Conditions for the Conduct of Security Activities, approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 18, 2015 No. 960.

It is possible to eliminate these shortcomings by providing a copy of the employment contract certified by the license applicant, indicating in it the position of a specialist in accordance with the requirements of the legislation, as well as a copy of a document confirming at least three years of experience of his work in the positions of the officer staff in the operational and investigative units of the internal affairs bodies or positions of the middle and senior leadership of law enforcement agencies.

In accordance with paragraph 1 of part three of Article 13 of the Law of Ukraine “On Licensing of Business Activities”

I ORDER:

1. To refuse to issue a license to conduct security activities to an individual — entrepreneur of SIDAK IVAN SERGIOVICH (registration number of the taxpayer's registration card and other mandatory payments 3229704631, place of residence: Malaya Lyubov street, house 18, apartment 36, Kharkiv city, 61098, application dated February 04, 2022 № 04 10357).

2. Department of Communications (Andreev D.) to ensure the posting of this order on the official website of the Ministry of Internal Affairs for the publication of the working day decision on the next day.

3. The licensing department (Chubayevsky V.) to ensure control over the execution of this order.
