The Ministry of Internal Affairs of Ukraine received an application from an individual — entrepreneur KOVAL KIM VASYLOVICH (hereinafter — the license applicant) about obtaining a license to conduct economic activities for the production of weapons and ammunition.
Based on the results of consideration of the application, it was established that there were grounds for leaving it without consideration.
Thus, for violation of the requirements of the License Terms, the conduct of economic activities for the production and repair of non-military firearms and their ammunition, cold weapons, pneumatic weapons with a caliber of more than 4.5 millimeters and a bullet flight speed of more than 100 meters per second, trade in non-military firearms and ammunition for it, cold weapons, pneumatic weapons of caliber over 4.5 millimeters and a bullet flight speed of more than 100 meters per second; production of special equipment charged with tear and annoying action, personal protection, active defense and their sale, approved by the Resolution of the Cabinet of Ministers of Ukraine dated December 02, 2015 No. 1000 (hereinafter — License Terms), the license applicant did not provide information about the place of business activities (Appendix 11); certified copy of the document confirming the right of ownership rental or rental of premises for the conduct of economic activities; a copy of the permission to open the object of the permit system; a copy of the document confirming the absence of medical contraindications to the performance of functional duties and possession of weapons, special means, which is issued in the prescribed manner; a copy of the certificate of study of the material part of the weapon, special means, the rules for handling them and their application; a copy of the passport; a description of the documents submitted for obtaining a license (Appendix 2), in duplicate.
In the information provided by the license applicant on the availability of places of economic activity for low-mobility groups of the population (Appendix 13), the entry in the column “Place of business activity” does not meet the requirements of paragraph 41 of the License Conditions, but information about the type of products to be produced (weapons, ammunition for it, special means), do not correspond to the content of Annex 12.
In addition, in the application for obtaining a license, the license applicant indicated a part of the type of economic activity that does not correspond to the type of activity defined in paragraph 11 of Article 7 of the Law of Ukraine “On Licensing of Business Activities”.
It is possible to eliminate these shortcomings by indicating in the application for a license the type of business activity or part of it in accordance with the requirements of the legislation, as well as the provision of documents and information provided for in paragraph 5 of the License Conditions. In this case, the information provided must comply with the form and content of Annexes 11, 12 and 13.
In accordance with paragraphs 1 and 2 of the second part of Article 12 of the Law of Ukraine “On Licensing of Business Activities”
I ORDER:
1. Leave without consideration the application of an individual — entrepreneur KOVAL KIM VASYLOVICH (place of residence: city of Sarny, Rivne region, 34500, registration number of the taxpayer's account card and other mandatory payments 3069910670) dated July 20, 2022 No. 38340 on obtaining a license for conducting economic activities for the production of weapons and ammunition sews.
2. Department of Communications (Andreev D.) to ensure that the order is posted on the official website of the Ministry of Internal Affairs for publication no later than the working day following the day of adoption of this decision.
3. The licensing department (Chubayevsky V.) to ensure control over the execution of this order.
