No. 1110 “On Amendments to the Order of the Ministry of Internal Affairs of Ukraine of December 07, 2009 No. 515” (hereinafter — Order No. 1110), registered in the Ministry of Justice of Ukraine on February 06, 2020 under No. 139/34422.

Ministry of Internal Affairs of Ukraine.

3. Objectives of the adoption of the act

The main goal of the development of the order No. 1110 is to improve the organization of the workflow of institutions that carry out training, retraining and professional development of drivers of vehicles (hereinafter - institutions).

The regulatory act provides:

coordination and introduction of legal norms defined by the Instruction on the Procedure for Organization and Control over the Training, Retraining and Upgrading of Vehicle Drivers, approved by the Order of the Ministry of Internal Affairs of Ukraine of December 07, 2009 No. 515, registered with the Ministry of Justice of Ukraine on January 22, 2010 under No. 73/1715 368, in accordance with the requirements of the legislation;

introduction of electronic exchange of information between institutions and territorial bodies for the provision of service services of the Ministry of Internal Affairs;

cancellation of the procedure for acquiring in the territorial bodies for the provision of service services of the Ministry of Internal Affairs of forms of certificates of completion of the institution.

6. Methods for obtaining tracking results

To re-track the effectiveness of the regulatory act, a statistical method of obtaining results was used.

7. Data and assumptions based on which performance was tracked, as well as ways of obtaining data

The results of tracking the specified regulatory act were obtained on the basis of the analysis of data obtained from the Unified State Register of the Ministry of Internal Affairs for the period from January 25, 2021 to December 01, 2021.

8. Quantitative and qualitative values of indicators of the effectiveness of the act

For the tracking, the indicators that were determined during the preparation of the regulatory impact analysis were used:

the number of business entities and/or natural persons covered by the act;

The action of the regulatory act applies to all business entities that train, retrain and improve the qualification of drivers of vehicles.

As of December 01, 2021, the Unified State Register of the Ministry of Internal Affairs has accumulated information on 1827 business entities that train, retrain and improve the qualification of drivers of vehicles;

the amount of revenues to the state and local budgets and state appropriations related to the action of the act

The regulatory act does not provide for receipts to state and local budgets and state target funds, since its action is aimed at improving the organization of the work process of institutions by introducing electronic exchange of information between institutions and territorial bodies for the provision of services of the Ministry of Internal Affairs;

the amount of funds and time spent by business entities and/or individuals related to the fulfillment of the requirements of the act

the level of awareness of business entities and/or individuals on the main provisions of the act

A high level of awareness was ensured by posting order No. 1110 on the official website.

In addition, according to the results of data analysis for the reporting period:

institutions have prepared candidates for driver - 593 119;

territorial bodies for the provision of service services of the Ministry of Internal Affairs issued driver's licenses — 968 791.

9. Evaluation of the results of the implementation of the regulatory act and the degree of achievement of the specified goals

The regulatory act introduced electronic exchange of information between institutions and territorial bodies for the provision of services of the Ministry of Internal Affairs and canceled the procedure for acquiring forms of certificates of termination of the institution.

The amount of expenses of business entities in case of non-implementation of a regulatory act

According to the results of the above calculation, it was established that in the event of non-implementation of the regulatory act, the expenses of business entities only for the procedure of purchasing forms of certificates of completion of the institution could amount to approximately UAH 461 thousand for the reporting period with minimum calculations.

Instead, as seen from the calculations of the indicator “amount of funds and time spent by business entities and/or individuals related to the fulfillment of the requirements of the act”, the expenses of business entities amount to UAH 65,972.97 for the reporting period.

In view of the foregoing, taking into account the data of re-tracking the effectiveness of the regulatory act, it can be concluded that the introduction of electronic exchange of information between institutions and territorial bodies for the provision of service services of the Ministry of Internal Affairs allowed to reduce the costs of entities that carry out training, retraining and training of drivers of vehicles, almost 7 times.

Therefore, the implementation of the regulatory act has a positive impact on business entities and today does not require revision.
