Report on re-tracking the effectiveness of the regulatory act of the Cabinet of Ministers of Ukraine of April 03, 2019 № 320 “On Amendments to Certain Decisions of the Cabinet of Ministers”

Resolution of the Cabinet of Ministers of Ukraine of April 03, 2019 No. 320 “On Amendments to Certain Resolutions of the Cabinet of Ministers of Ukraine” (hereinafter referred to as the Resolution).

Ministry of Internal Affairs of Ukraine.

 

3. Objectives of the adoption of a regulatory act

The main goals of the adoption of the Resolution are to reduce administrative pressure on business entities in the field of training drivers of vehicles, simplify the procedure for state accreditation of institutions that carry out training, retraining and training of drivers of vehicles, create more comfortable conditions for interaction with territorial bodies for the provision of service services Ministry of Internal Affairs, as well as improvement of the procedure for obtaining and exchanging driver's licenses.

Implementation of measures to track the performance of the regulatory act was carried out in the period from September 13 to October 01, 2021.

6. Methods for obtaining tracking results

To re-track the effectiveness of the regulatory act, a statistical method of obtaining results was used.

 

7. Data and assumptions based on which performance was tracked, as well as ways of obtaining data

Tracking the effectiveness of the Resolution was carried out by analyzing the Unified State Register of the Ministry of Internal Affairs.

For tracking, indicators were used:

the amount of revenues to the state and local budgets and state appropriations related to the action of the act;

the number of business entities and/or natural persons covered by the act;

the amount of funds and time spent by business entities and/or individuals related to the fulfillment of the requirements of the act;

the level of awareness of business entities and/or individuals on the main provisions of the act;

the number of establishments engaged in training, retraining and further training of drivers of vehicles that have passed state accreditation and received the corresponding certificate;

the number of issued certificates of completion of an institution that trains, retrains and advanced training of drivers of vehicles.

As of October 01, 2021, the Unified State Register of the Ministry of Internal Affairs has accumulated information on 1801 business entities that train, retrain and improve the qualification of drivers of vehicles

High level of awareness was ensured by posting the Resolution on the official website of the Ministry of Internal Affairs of Ukraine

 

* The calculation was made taking into account the requirements of the Order of the Ministry of Internal Affairs of Ukraine dated September 25, 2010 No. 461 “On Approval of the Amount of Fee for State Accreditation of Institutions Training, Retraining and Retraining of Vehicle Drivers”, registered in the Ministry of Justice of Ukraine on October 15, 2010 for No. 929/18224 (hereinafter — Order No. 461).

In accordance with the order No. 461, the fee for the certificate of state accreditation of an institution that conducts training, retraining and further training of drivers of vehicles (hereinafter referred to as the institution) is 195 UAH.

For the period from October 02, 2020 to October 01, 2021, 299 institutions were accredited.

The amount of revenues to the state and local budgets was calculated by multiplying the cost of accreditation (195 UAH) by the number of accredited institutions (299).

9. Evaluation of the effectiveness of the implementation of the regulatory act and the degree of achievement of the specified goals

Since the entry into force, the Decree has reduced administrative pressure on business entities engaged in the field of training, retraining and upgrading of vehicle drivers, by abolishing the procedure for purchasing from the territorial bodies for the provision of service services of the Ministry of Internal Affairs of the forms of certificates of completion of the institution, replacing by introducing the appropriate electronic forms of these certificates into the Unified State Register of the Ministry of Internal Affairs, as well as by introducing remote electronic registration of groups to undergo training.

Before the introduction of the regulatory act, the expenses of 299 business entities only for the procedure of purchasing forms of certificates of termination of the institution could amount to more than UAH 1.2 million for the reporting period.

In addition, the procedure for state accreditation for institutions has been simplified, in particular, the authority to decide on state accreditation of institutions is delegated to regional service centers of the Ministry of Internal Affairs.

Thus, the time for passing this procedure is shortened, since instead of one state body (GSC of the Ministry of Internal Affairs), documents on state accreditation are considered in twenty-five territorial bodies at the location of the institutions, which allowed economic operators to reduce time and transport costs.

Therefore, the adoption of the Resolution allowed to reduce the costs of entities by more than 1 million UAH (at minimum calculations).

In view of the foregoing, taking into account the data of re-tracking the effectiveness of the regulatory act, it can be concluded that its implementation allowed to achieve certain goals by simplifying the procedure for state accreditation of institutions, creating more comfortable conditions for interaction of economic entities with territorial bodies for the provision of service services of the Ministry of Internal Affairs, and Consequently, the regulatory act achieves its goal.
