Report on periodic monitoring of the effectiveness of the order of the Ministry of Internal Affairs of Ukraine dated April 14, 2016 № 303 “On Amendments to the Order of the Ministry of Internal Affairs of Ukraine of 21.03.2008 № 130 “On the safety of transportation of dangerous goods by road”

1. Type and name of the regulatory act

Order of the Ministry of Internal Affairs of Ukraine dated April 14, 2016 No. 303 “On Amendments to the Order of the Ministry of Internal Affairs of Ukraine of 21.03.2008 No. 130 “On the Safety of Transportation of Dangerous Goods by Road” (hereinafter — the regulatory act).

Ministry of Internal Affairs of Ukraine.

 

3. Objectives of the adoption of the act

The regulatory act was developed in accordance with Article 52-1 of the Law of Ukraine “On Road Traffic” and Article 16 of the Law of Ukraine “On the Transportation of Dangerous Goods”.

The purpose of the regulatory act is to provide organizational support for the adoption by the relevant service centers of the Ministry of Internal Affairs of examinations on the verification of knowledge of the rules of transportation of dangerous goods by road for drivers of vehicles and authorized persons for the safety of the transportation of dangerous goods and the issuance of relevant certificates by amending the Regulations on the procedure of special training of drivers of vehicles carrying dangerous goods and on safety officers for the transport of dangerous goods by road and Instructions on the procedure for taking exams, issuing (exchanging) DOPN-certificates on the training of drivers of vehicles transporting dangerous goods, certificates on the training of authorized persons for the safety of transportation of dangerous goods, as well as on the registration and storage of documents, which is the basis for issuing DOPN-certificates and certificates on the preparation of authorized persons approved by the order of the Ministry of Internal Affairs of Ukraine dated March 21, 2008 No. 130, registered with the Ministry of Justice of Ukraine on April 15, 2008 under No. 309/15000.

 

4. Term of implementation of measures for periodic monitoring of the effectiveness of the regulatory act

The deadline for the implementation of tracking measures is from October 15 to November 15, 2021.

6. Methods for obtaining tracking results

Tracking the effectiveness of the regulatory act is carried out by analyzing information on the number of trained (retrained) drivers of vehicles involved in the road transportation of dangerous goods and the number of trained authorized persons whose activities are related to the transportation of dangerous goods by road, as well as information on the number of issued DOPN-aware Certificates for the training of drivers of vehicles carrying dangerous goods and certificates for the training of dangerous transport safety officers cargoes.

 

7. Data and assumptions based on which performance was tracked, as well as methods of obtaining data

The results of tracking the specified regulatory act were obtained on the basis of the analysis of data obtained from the Unified State Register of the Ministry of Internal Affairs on the number of trained (retrained) drivers of vehicles involved in the road transportation of dangerous goods, authorized persons whose activities are related to the transportation of dangerous goods by road as well as the number of issued DOPNV-certificates on the training of drivers of vehicles transporting dangerous goods and certificates on the training of transport safety officers dangerous goods.

 

8. Quantitative and qualitative values of indicators of the effectiveness of the act

The implementation of the regulatory act did not require the allocation of additional funds to ensure the proposed regulation.

The publication and implementation of the regulatory act did not entail additional costs from the State Budget of Ukraine.

The action of the regulatory act applies to all business entities engaged in the training (retraining) of drivers of vehicles transporting dangerous goods and authorized persons for the safety of transportation of dangerous goods by road.

The action of the act did not lead to an increase in the cost of works or an increase in the duration of their performance for business entities associated with the fulfillment of the requirements of the act.

The level of awareness of business entities and/or individuals on the main provisions of the regulatory act is high and was ensured by placing the order on the official website of the Ministry of Internal Affairs of Ukraine, in printed official state publications and on information stands of the authorized bodies of the Ministry of Internal Affairs.

Ensuring proper conditions for the preparation (retraining) of drivers of vehicles transporting dangerous goods and authorized persons for the safety of transportation of dangerous goods by road before the entry into force of the act was impossible due to the non-compliance of the regulations and legal acts of the Ministry of Internal Affairs with the current legislation.

From the date of the end of the measures to re-track the performance of this regulatory act according to the results of the data analysis:

trained, retrained drivers carrying out the transportation of dangerous goods — 44 930;

Commissioners whose activities are related to the road transportation of dangerous goods have been prepared — 2114;

DPO certificates on the training of drivers of vehicles carrying dangerous goods were issued — 43 371;

issued certificates on the training of authorized persons for the safety of transportation of dangerous goods, — 2072.

Thus, the performance indicators of the regulatory act remain at a fairly high level compared to the values of similar indicators established during re-tracking, in particular, more than 96% of drivers trained (retrained) by special training centers for the transportation of dangerous goods and 98% of authorized persons whose activities are related to road crossing transportation of dangerous goods, passed an exam to test knowledge of the rules of transportation of dangerous goods by road and received certificates of the established model in service centers of the Ministry of Internal Affairs.

 

9. Evaluation of the possible results of the implementation of the regulatory act and the degree of achievement of the specified goals

Based on the results of re-tracking the effectiveness of this regulatory act, it can be concluded that its implementation contributes to the proper settlement of the issue of bringing the regulatory acts of the Ministry of Internal Affairs into compliance with the legislation and provides adequate conditions for passing the relevant service centers of the Ministry of Internal Affairs of Ukraine exams to check knowledge of the rules of transportation of hazards cargoes by road from drivers of vehicles and authorized persons for the safety of transportation of dangerous goods and the issuance of appropriate certificates of the established model.
