Regulatory Act 1045 Baseline Performance Tracking Report

1. Type and name of the regulatory act

Resolution of the Cabinet of Ministers of Ukraine dated October 06, 2021 No. 1045 “On Amendments to the Standard Training Program for Training and Retraining of Vehicle Drivers” (hereinafter referred to as the Resolution).

 

2. Name of the performer of performance tracking activities

Ministry of Internal Affairs of Ukraine.

 

3. Objectives of the adoption of the act

The main objectives of the adoption of the Resolution are:

improving the quality of training and retraining of drivers of vehicles;

proper organization of the preparatory training process in institutions that carry out training and retraining of drivers of vehicles;

increasing the level of road safety, reducing the number of traffic accidents, reducing the mortality rate due to traffic accidents, as well as their severity, creating safe and comfortable conditions for road users.

4. Deadline for performance tracking

Implementation of measures to track the performance of the regulatory act was carried out in the period from October 18 to November 19, 2021.

6. Methods for obtaining tracking results

To conduct a basic tracking of the effectiveness of the regulatory act, a statistical method of obtaining results was used.

7. Data and assumptions based on which performance was tracked, as well as ways of obtaining data

Tracking the effectiveness of the Resolution was carried out by analyzing the Unified State Register of Vehicles of the Ministry of Internal Affairs.

For tracking, indicators were used:

the amount of revenues to the state and local budgets and state appropriations related to the action of the act;

the number of business entities and/or individuals to whom the act will apply;

the amount of funds and time that will be spent by business entities and/or individuals related to the fulfillment of the requirements of the act;

the level of awareness of business entities and/or individuals on the main provisions of the act;

the number of educational institutions that train and retrain drivers;

the number of individuals who have completed the training and retraining of vehicle drivers in accordance with the approved programs (plans).

The implementation of the Resolution did not require the allocation of additional funds to ensure the proposed regulation and did not entail additional costs from the State Budget of Ukraine.

As of October 01, 2021, the Unified State Register of the Ministry of Internal Affairs has accumulated information on 1821 business entities that train, retrain and improve the qualification of drivers of vehicles.

The level of awareness of business entities on the main provisions of the regulatory act

A high level of awareness was ensured by posting the Resolution on the official website of the Ministry of Internal Affairs of Ukraine.

 

* As of October 18, 2021, this indicator cannot be investigated, since in accordance with paragraph 2 of the Resolution, accredited institutions and their branches (other separate units) that carry out training, retraining and retraining of drivers of vehicles, within six months from the date of entry into force of this resolution must provide work programs and plans for the training, retraining and professional development of drivers in accordance with the requirements of this Regulation.

The indicator will be investigated during the implementation of measures to re-track the effectiveness of the regulatory act.

9. Evaluation of the effectiveness of the implementation of the regulatory act and the degree of achievement of the specified goals

In accordance with paragraph 2 of the Decree, accredited establishments and their branches (other separate units) that carry out training, retraining and retraining of drivers of vehicles, within six months from the date of entry into force of this resolution must provide work programs and plans for the training, retraining and retraining of drivers in response to compliance with the requirements of this resolution.

Taking into account the above, the conclusion on the effectiveness of the regulatory act will be made on the basis of the results of a comparative analysis of indicators from repeated and periodic tracking.
