Notice on the publication of the draft resolution of the Cabinet of Ministers of Ukraine “On Amendments to the Decisions of the Cabinet of Ministers of Ukraine dated January 30, 2013 No. 55 and November 18, 2015 No. 960” and ana

In accordance with Articles 9, 13 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity” (hereinafter referred to as the Law), in order to receive comments and proposals from individuals and legal entities, their associations are published:

draft resolution of the Cabinet of Ministers of Ukraine “On Amendments to the Decisions of the Cabinet of Ministers of Ukraine dated January 30, 2013 No. 55 and November 18, 2015 No. 960” (hereinafter referred to as the draft resolution) and analysis of its regulatory impact.

The developer is the Ministry of Internal Affairs of Ukraine.

The draft resolution was developed by the Ministry of Internal Affairs of Ukraine on its own initiative in order to ensure the implementation of the provisions of Article 3 of the Constitution of Ukraine, which determines that a person, his life and health, inviolability and security are recognized as the highest social value in Ukraine.

The obligation of the state to exercise the right to life is considered to be the obligation of the state to create adequate conditions for the realization of this right.

Due to the increase in the number of criminal offenses related to the illegal trafficking and handling of firearms, ammunition and explosives, there is a need to use measures aimed at ensuring the financial and economic security of enterprises and the protection of security personnel during the implementation of the protection of dangerous and valuable cargo during their transportation by road.

One of these measures is to increase the class of protection of armored vehicles carrying out such transportation.

The draft resolution provides for amendments to the Conditions for the Protection of Dangerous and Valuable Cargoes during their transportation by road and the License Conditions for conducting security activities in terms of raising the class of protection of road transport not lower than the third according to DSTU 3975-2000 “Protection of armored specialized vehicles. General technical requirements” (in the case of protection of money, precious metals and precious stones), equipping it with a video recorder and a system for tracking moving objects with the transmission of an alarm signal to the centralized observation point of territorial bodies of the National Police or other entities of security activities, determination of the procedure for interaction with law enforcement agencies, the procedure for actions of security personnel in case of occurrence or threat of occurrence of emergency situations on routes, commission of unlawful encroachments on response transport or security personnel, dangerous and valuable cargoes being transported, and prompt notification of the territorial bodies of the National Police.
