On refusal to issue a license to conduct security activities

The Ministry of Internal Affairs of Ukraine applied to the Ministry of Internal Affairs of Ukraine for the issuance of a license for the implementation of security activities by the subsidiary enterprise “VODOECOTECHPROM” of the Rivne Regional Production Utility of Water Supply and Sewerage Industry “RIVNEVLVODOKANAL” (hereinafter — the license applicant). According to the results of consideration of the application and supporting documents submitted by the license applicant, it was established that the position of the head of the department of protection of objects part-time Oleksiyevets Anatoly Adamovich, who is entrusted with the duty of a specialist in the organization of security measures, with the requirements of paragraph eight of the first part of Article 1 of the Law of Ukraine “On security activities.”

In violation of the requirements of the License Conditions for the Conduct of Security Activities, approved by the Resolution of the Cabinet of Ministers of Ukraine of November 18, 2015 No. 960, all employees of the security personnel of the license applicant were not provided with copies of documents confirming the absence of health restrictions for the performance of functional duties issued in the established order.

In addition, the employees of Shulyak Leonid Vasilyevich do not have a copy of the document confirming the qualification of a security guard, and Kovalchuk Vladimir Ivanovich does not have an entry in the work book about employment as a security guard.

It is possible to eliminate these shortcomings by providing documents on a specialist in the organization of security measures, who, in accordance with the requirements of the above-mentioned Law, must be the head of the security entity or his deputy, the head of a branch, another separate structural unit or his deputy, whose official duties include the organization and conduct of security measures, control in the performance of the duties assigned to it by the security personnel. Regarding security personnel — copies of the document confirming the absence of health restrictions for the security personnel to perform functional duties, issued in the prescribed manner; copies of the document confirming the qualification of security guard Shulyak L. C; copies of the workbook of Kovalchuk V. I. with the appropriate employment record.

On the basis of paragraph 1 of part 3 of Article 13 of the Law of Ukraine “On Licensing of Business Activities”

I ORDER:

1. Refuse to issue a license to conduct security activities to a subsidiary of “VODOECOTECHPROM” of Rivne Regional Production Municipal Enterprise of Water Supply and Sewerage Industry “RIVNEPLVODOKANAL” (identification code 43540208, location: Stepana Bandery Street, house 2, Rivne city, 33030 28, statement dated September 04, 2020 No. 573-2020).

2. Department of Communications (Shevchenko A.) to ensure the posting of this order on the official website of the Ministry of Internal Affairs for the publication of the working day decision on the next day.

3. Licensing Administration (Kamyshanov V.) to ensure control over the execution of this order.
