On refusal to issue a license to conduct security activities

19 license applicants applied to the Ministry of Internal Affairs of Ukraine for obtaining licenses for conducting security activities.

According to the results of consideration of applications and supporting documents submitted by limited liability companies “SECURITY COMPANY “TT”, “KAMRAT” SECURITY AGENCY”, “SECURITY SERVICE COMPANY”, “SECURITY COMPANY “MILLION”, “BESTPLUS TRADE”, “QUICK RESPONSE UNIT “ALABAY”, “RAPID RESPONSE UNIT “SERVAL”, “SIRIUS SECURITY”, “OK “SCORPION-L”, “BLACK SYSTEMS”, “DAN START”, “VARANT OPTIMA”, “NON-AGENCY SECURITY - AZOV”, PRIVATE ENTERPRISES “SECURITY - 333”, “SECURITY. REGION. 2020", the corporation “SHERIFF”, the individual — entrepreneur LAVRENYUK VADIM ANATOLIYOVICH, established the existence of discrepancies between the data in the supporting documents and the actual state of these business entities at the time of submission of the documents.

Thus, employment contracts are concluded between license applicants in the person of the founder or director as an employer and an employee who is accepted as a director or deputy director with the duties of a specialist in organizing security measures. These employment contracts are concluded at the main place of work and do not provide for part-time work, and therefore, there is a violation of labor legislation, since according to the terms of these contracts it is impossible to simultaneously perform by a specialist in the organization of labor protection measures in several business entities.

In addition, according to the results of consideration of applications and supporting documents submitted by the limited liability company “SHIELD — DC” and the private enterprise “REITER SECURITY”, it was established that the license applicants did not comply with the license conditions, namely, the qualification of the director of LLC “SHIELD — DC” was not confirmed Buluy Vadim Petrovich and employee of PR “REUTERS SECURITY” Dorchuk Sergey Petrovich, who are entrusted with the duties of a specialist in organizing security measures.

Thus, according to a copy of the work book of Buluy Vadim Petrovich, which is not certified by the business entity, his work experience as director of the security entity is less than three years. To confirm the work experience, a copy of the certificate dated 06.08.2020 No. 2, issued by the director of the limited liability company “SHIELD — CR” Bulia Vadim Petrovych, stating that he worked as a director of this company on a part-time basis from 01.11.2017 to 27.12.2019 is also attached. At the same time, the study of the license case of the company “SHIELD — CR” established the absence of any documents regarding his employment.

According to a copy of the work book of Dorchuk Sergey Petrovich, it is also established that his work experience as a deputy director of security entities is less than three years, and a copy of the document confirming the work experience of at least three years in the positions of the officer staff in the operational and investigative units of the internal affairs bodies is absent nija.

In addition, in violation of the requirements of Article 1 of the Law of Ukraine “On Security Activities”, an entry of the position was made in the work book of Bului Vadim Petrovich and in the employment agreement concluded between the director of the private enterprise “REATER SECURITY” and the employee Dorchuk Sergey Petrovich, on which the duties of a specialist in the organization of security measures are assigned, since a specialist in the organization of security measures is the head of the security entity or his deputy, the head of a branch, another separate structural unit or his deputy, to official duties which includes the organization and conduct of security measures, control over the performance of the duties assigned to it by the security personnel.

It is possible to eliminate these shortcomings by concluding contracts for the employment of an employee who is entrusted with the performance of the duties of a specialist in the organization of security measures, in accordance with the procedure established by law, as well as sending documents confirming the qualifications of Bului Vadim Petrovich and Dorchuk Sergey Petrovich, in accordance with the requirements of paragraph 14 Licensing conditions for the conduct of security activities, approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 18, 2015 No. 960, and to list their positions in the work book and employment agreement in compliance with the requirements of Article 1 of the Law of Ukraine “On Security Activities”.

In accordance with paragraphs 1 and 2 of the third article 13 of the Law of Ukraine “On Licensing of Business Activities”
