On leaving without consideration of the application for a license

The Ministry of Internal Affairs of Ukraine with an application for obtaining licenses for conducting business activities for the production of personal protective equipment was addressed by the Representation of “ECCENTRICity INVEST S.R.O.”.

Based on the results of consideration of the application, it was established that there were grounds for leaving it without consideration.

Thus, in accordance with the second paragraph 1 of part 2 of Article 11 of the Law of Ukraine “On Licensing of Business Activities”, the application for obtaining a license must contain information about the license applicant: for a legal entity — full name, identification code, location, list of separate units within which it is planned to proceed business activities subject to licensing, and part seven of Article 12 stipulates that for the purposes of this Law, information from the Unified State Register of Legal Entities, Natural Persons is used persons — entrepreneurs and public organizations (hereinafter — EDR).

In accordance with Article 80 of the Civil Code of Ukraine, a legal entity is an organization established and registered in accordance with the procedure established by law.

The Law of Ukraine “On State Registration of Legal Entities, Individual Entrepreneurs and Public Organizations” stipulates that the state registration of legal entities is the official recognition by means of certification by the state of the fact of creation or termination of a legal entity, changes in the information contained in the Unified State Register about a legal entity, as well as carrying out other registration actions provided for by it By law.

According to the fourth part of Article 87 of the Civil Code of Ukraine, a legal entity is considered to be established from the date of its state registration, and in accordance with part four of Article 91 of this Code, the civil legal capacity of a legal entity arises from the moment of its creation and ceases from the date of entry into the Unified State Register of its termination.

At the same time, there is no information about the license applicant — a legal entity “EccentriCity INVEST S.r.o.” Representation in the Unified State Register.

It is possible to eliminate these shortcomings by obtaining the status of a legal entity by the license applicant.

In accordance with paragraph 4 of part 2 of Article 12 of the Law of Ukraine “On licensing of economic activities”

I ORDER:

1. Leave without consideration the application dated 03.09.2020 № 570-2020 of the Representative Office “EccentriCity INVEST s.r.o.” (location: Varvara Dovzhenko street, building 86-A, Demidiv village, Vyshhorod district, Kyiv region, 07335,) to obtain a license to conduct business activities for the production of personal protective equipment.

2. Department of Communications (Shevchenko A.) to ensure that the order is posted on the official website of the Ministry of Internal Affairs for publication no later than the working day following the day of adoption of this decision.

3. Licensing Administration (Kamyshanov V.) to ensure control over the execution of this order.
