REPORT on the implementation
of the Action Plan of the Ministry of Internal Affairs of Ukraine on the implementation of the State Policy Strategy for the Promotion of Civil Society Development in Ukraine in 2015


In accordance with the Resolution of the Cabinet of Ministers of Ukraine dated December 25, 2013 No. 968 “On Approval of the Procedure for Planning and Monitoring the Implementation by the Executive Authorities of the Strategy of State Policy for Promoting Civil Society Development in Ukraine”, the Order of the Ministry of Internal Affairs of Ukraine dated 26.01.2015 No. 80 approved the Action Plan of the Ministry of Internal Affairs of Ukraine on the implementation of the Ministry of Internal Affairs of Ukraine State Policy Strategy for Promoting the Development of Civil Society in Ukraine for 2015 (hereinafter referred to as the Plan).

 

This Plan provided for:

1. Ensuring the work of the Public Council under the Ministry of Internal Affairs in accordance with its work plan for 2015.

Thus, in August 2015, the Public Council was created under the Ministry of Internal Affairs of Ukraine. It includes 22 people — representatives of public organizations of human rights orientation, which are known for their active activities in the field of human rights protection, and representatives of the Ministry of Internal Affairs of Ukraine. Vladimir Alexandrovich Martynenko was elected Chairman of the Public Council. The composition of the Public Council was approved by the order of the Ministry of Internal Affairs of Ukraine dated 08.09.2015 №1083.

The Council has established 5 committees in several areas of work — organizing and conducting public consultations, conducting public examinations, monitoring public opinion on the activities of the Ministry of Internal Affairs and European integration. The Regulation on the Public Council under the Ministry of Internal Affairs of Ukraine has been approved.

The Public Council approved working groups in the areas of activity:
- solving problematic issues of social and legal protection of employees of the Ministry of Internal Affairs, veterans, ATO participants and members of their families; - creation of municipal police;

- cooperation and interaction with the Service Center;

- protection of cultural heritage and construction in historical places;
- cooperation with structural units of the Ministry of Internal Affairs of Ukraine in the regions;

- organization of cooperation with the internal security bodies of the National Police.

Ensuring public participation in the discussion of draft regulations on the creation and activities of the “Municipal Police”, as an institution of civil society.


2. A number of scientific events were held in the internal affairs bodies - conferences, round tables. During their work, among others, the issues of public participation in the discussion of draft regulations on the creation and activity of the “Municipal Police” as an institution of civil society were considered.


3. Conducting the International Scientific-Practical Conference “Priority directions of development and reform of the OHS in the context of the development of democratic processes in the state”.


4. Organization of “Open Days” in higher educational institutions of the Ministry of Internal Affairs for familiarization with the conditions of training in educational institutions of the Ministry of Internal Affairs system of persons planning to enter and study in these institutions;

In the higher educational institutions of the internal affairs bodies of Ukraine during 2015, “Open Days” and introductory excursions for students of general educational institutions were organized.

University teachers systematically hold meetings with subordinate institutions, specialized lyceums and general education schools. They offer education at universities and serve in internal affairs bodies. During their speeches, they focus on issues of intolerance to corruption and the need for legitimate behavior in all spheres of public life.


5. Holding a round table dedicated to the 67th anniversary of the adoption by the General Assembly of the Universal Declaration of Human Rights.

A number of events were held to mark the 67th anniversary of the adoption of the Universal Declaration of Human Rights by the General Assembly. Lectures “Place of the European Convention on the Protection of Human Rights and Fundamental Freedoms in the Legal System of Ukraine” and the All-Ukrainian Lesson “Human Rights” were held in the general educational institutions of the cities by the scientific and pedagogical staff of the universities of the CIS.

Round tables were also held on the 67th anniversary of the adoption by the UN General Assembly of the Universal Declaration of Human Rights.


6. Ensuring the activities of “Legal Clinics” in the implementation of legal education of citizens, popularization of the activities of the police, their role in ensuring the stable functioning and development of the institute of civil society in Ukraine.

Legal clinics operate on the basis of higher educational institutions of the system of the Ministry of Internal Affairs of Ukraine. They were created in order to provide free assistance to the population on issues of protection of rights and freedoms in all branches of law in accordance with the current legislation of Ukraine and for senior students to gain practical experience in their specialty. The quality of such assistance is guaranteed by the patronage system for the activities of the legal clinic of teachers, scientists and involved lawyer-practitioners.

Consultants of “Legal Clinics” of universities provide legal assistance to the population in the form of oral and written consultations, draw up claims, complaints, petitions, etc. under the guidance of teachers who provide the necessary methodological and theoretical support.

Also, lecturers who practice law and ensure the participation of students in court sessions as representatives of the parties are involved in the work of these clinics.

“Legal clinics” also carry out activities on legal education of the population — the sites have relevant headings, representatives of these clinics visit general educational institutions, where they give lectures, hold talks, etc.


7. Ensuring the preparation and submission to the Cabinet of Ministers of Ukraine of general information on conducting consultations with the public in the Ministry of Internal Affairs of Ukraine, as well as proposals for improving the practice of their conduct.


8. Conducting a regional scientific and practical seminar “Ensuring the right to work and to social protection in the conditions of Ukraine's accession to the EU”.

On October 9, 2015, a regional scientific and practical seminar “Ensuring the right to work and the right to social protection in the conditions of Ukraine's accession to the EU” was held at Lviv State University of Internal Affairs.

The event was attended by scholars of the Faculty of Law, employees of the Department of Civil Law and Process of the Faculty for training specialists for the units of personnel support and public security police, students and cadets of LvDUVS. Among the participants of the seminar were also representatives of Lviv National University named after him. Ivan Franko, Carpathian Institute of Entrepreneurship University Open University of Development “Ukraine”, as well as representatives of the Main Department of the State Labor Department in Lviv region.

In general, the seminar worked in areas — the right to work and the right to social protection in the context of the European Social Charter; the right to work in the draft Labor Code of Ukraine; problems of improving the legislation of Ukraine in the field of employment; problems of employment of internally displaced persons; resolution of labor disputes in Ukraine; social protection of participants hostilities (ATO participants); social services in the system of social services of citizens.


9. Implementation of the project “Protection of Children's Rights in Ukraine”, initiated by the Council of Europe, through consultations, round tables and conferences.


10. Conducting the All-Ukrainian cadet-student scientific conference on the topic: “Mechanism of legal regulation of law enforcement and human rights protection activities in the conditions of formation of civil society”.

On November 20, 2015, the 12th All-Ukrainian cadet and student conference “Mechanism of legal regulation of law enforcement and human rights activities in the conditions of formation of civil society” took place on the basis of LvDUVS. The participants of the event represented the whole of Ukraine.

 

11. Ensuring interaction with civil society institutions, on the dissemination of ideas of intolerance to corruption among the population and promoting the advantages of legitimate behavior in all spheres of public life.

The departments of the internal affairs bodies of Ukraine have ensured cooperation with civil society institutions on the issues of dissemination among the population of ideas of intolerance to corruption and promotion of the advantages of lawful behavior in all spheres of public life. To this end, representatives of the following public organizations were involved in the work of the EMS.

Specialists of the State Research Institute of the Ministry of Internal Affairs of Ukraine (DNDI) during the current year within the scope of competence carried out interaction with civil society institutions on the dissemination of ideas of intolerance to corruption among the population and promotion of the advantages of lawful behavior in all spheres of public life through joint participation with public organizations in scientific activities.

In particular, these issues were discussed at such scientific and practical conferences and round tables as “Criminological theory and practice: experience, problems of the present and ways to solve them” (m. Kyiv, NAVS, 26.03.2015), “National Security Strategy of Ukraine in the Conditions of Radical Changes in the Internal and External Security Environment” (m. Kyiv, National Institute of Strategic Studies, 23.01.2015), “Actual problems of criminal law and criminology in the light of criminal justice reform” (m. Kharkiv, KHNUVS, 22.05.2015), etc.


I'm 12. Providing the Department of Communications and structural units of the Ministry of Internal Affairs of the Ministry of Internal Affairs of preparation and submission to the Cabinet of Ministers of Ukraine of generalized information on conducting consultations with the public in the Ministry of Internal Affairs of Ukraine, as well as proposals for improving the practice of their conduct.


I'm 13. Conducting consultations and other public outreach activities aimed at the implementation of “Reforming the Criminal Justice System for Minors in Ukraine”.


He's 14. Organization of consultations with civil society institutions, especially when making decisions related to public policy issues in the sphere of protection of human and citizen rights and freedoms.

During 2015, the Ministry of Internal Affairs of Ukraine conducted consultations with the public on 32 issues, of which: at roundtable meetings — 1; at public meetings, meetings — 4; in the form of electronic consultations (discussion on the body's website) — 27.

The units of the Ministry of Internal Affairs of Ukraine, within the limits of their powers, take an active part in the implementation of the tasks provided for in this Plan.

Together with representatives of human rights and non-governmental organizations, members of public councils on the basis of higher educational institutions, the Ministry of Internal Affairs conducted scientific events on the issues of ensuring human rights and freedoms in the activities of the Ministry of Internal Affairs, the preparation of relevant educational literature was carried out.

Employees of the Ministry of Internal Affairs constantly participate in events together with representatives of civil society institutions. Thus, on December 09, 2015, at the Round Table “Building Partnership and Communication between Law Enforcement Agencies and Minority Communities” with representatives of the OSCE, IOM, UNHCR and representatives of non-governmental organizations, the problems of preventing the commission of hate crimes were discussed.

On October 19, 2015, there was a meeting of representatives of structural units of the Ministry of Internal Affairs of Ukraine with the delegation of the All-Ukrainian Council of Churches and Religious Organizations at which the issues of cooperation on the observance of the rights of religious communities in Ukraine were discussed.

The Communications Department of the Ministry of Internal Affairs of Ukraine has prepared a draft Action Plan of the Ministry of Internal Affairs of Ukraine on the implementation of the Strategy of State Policy for Promotion of Civil Society Development in Ukraine for 2016, which is published on the website of the Ministry of Internal Affairs of Ukraine for public discussion.
