Acquisition of land of state property for UAH 5 million - criminal group will be tried in Dnipropetrovsk region
Among the accused are the ex-chief of the regional state administration, the director and employee of the state enterprise, the head of the structural unit of the State Property Fund and a local resident. The latter organized the activities of the group.
The activities of the grouping and the illegal “scheme” of privatization of the land plot of the state-owned enterprise were exposed by the operatives of the Directorate of Strategic Investigations in the Dnipropetrovsk region and the investigators of the Investigative Department of the Regional Police. The police established that the “scheme” was organized by a local resident. The accomplices involved the former head of the regional state administration, the director and employee of the state enterprise — the son of the organizer, and the head of the structural unit of the State Property Fund.
In accordance with the plan developed by the attackers, first a private enterprise was registered for one of the group participants, then the state enterprise, as a single property complex, was transferred from the sphere of management of the Regional State Administration to the structural unit of the State Property Fund and put up for auction. In the future, on the basis of the contract of sale and contrary to the current legislation, the new owner, in addition to the complex, illegally registered the right to permanent use and 131 hectares of land. According to Art. 28 Law “On Privatization of State and Communal Property” does not transfer to the buyer the right of permanent use of the land plot.
Thus, having acquired a single property complex at a price of more than 420 thousand UAH, intruders illegally seized land plots worth more than 5 million UAH.
The pre-trial investigation in criminal proceedings is completed, the indictment is directed to the Babushkin district court of the city. Dnipropetrovsk.
The actions of the organizer and the three defendants are qualified under several articles of the Criminal Code of Ukraine:
- abuse of power or official position (part 2 of Art. 28 part 2 of Art. 364);
- official counterfeiting (Part 3 of Article 28 of Part 1 of Art. 366);
- official negligence (part 2 of Art. 367);
- theft, appropriation, extortion of documents, stamps, seals, possession of them by fraud or abuse of official position or damage to them (part 2 of Art. 357);
- unauthorized occupation of land and unauthorized construction (Part 2 of Article 197-2);
- unauthorized actions with information that is processed in electronic computers (computers), automated systems, computer networks or stored on the media of such information, committed by a person who has the right to access it (part 3 of Art. 362).
The former head of the regional state administration is charged with committing a criminal offense provided for in Part 2 of Art. 367 (official negligence) of the Criminal Code of Ukraine. Procedural guidance in criminal proceedings was carried out by the Dnipropetrovsk Regional Prosecutor's Office.
