The businesswoman, who was accused of violating the rules of trade in excisable goods, had already received an administrative protocol for the sale of cigarettes and alcohol without excise stamps. The 37-year-old woman sold illegal cigarettes and alcohol in the central market, in the village of Novi Sanzhary, Poltava district.

Shadow trade in excisable goods was discovered by employees of the regional department of strategic investigations together with employees of the patrol police response sector of police department No. 3 (Novi Sanzhary) of Poltava regional administration.

For reference. The presence of an excise tax stamp affixed in the prescribed manner on a bottle (packaging) of an alcoholic beverage and a pack (packaging) of a tobacco product is one of the conditions for import into the customs territory of Ukraine and sale of such goods to consumers, as well as confirmation of tax payment and the legality of the import of goods (p. 226.2 of Article 226 of the Tax Code of Ukraine).

Maxim Akhrameyev, deputy chief of police of Poltava region, said: “During the course of documenting the offense, the police seized more than 1,300 packs of cigarettes and more than 200 liters of unlabeled alcohol in the amount of about 57.5 thousand hryvnias.”

Concerning the entrepreneur, a protocol was drawn up under part 4 of Article 156 of the Code of Ukraine on administrative offenses — violation of the rules of trade in alcoholic beverages and tobacco products by an employee of a trading enterprise, who during the year was subject to administrative penalties for the same violations. Administrative materials are sent to the Novosanzhara District Court of Poltava region for the adoption of a legal decision.
