In Donetsk region, a lawyer was exposed who voluntarily sold the apartment of his defendant and appropriated the proceeds
The attacker, using a fraudulent scheme, gained the right to dispose of his client's property, namely the fate in two three-room apartments in Mariupol. As a result of the criminal actions of the lawyer, the woman lost both the housing and the money received from its sale. Thanks to the joint measures of the investigative department and the criminal investigation department of the police under the procedural guidance of the Donetsk Regional Prosecutor's Office, the lawyer appeared before the court.
Investigators obtained information about a lawyer who was looking for a client. A 46-year-old man learned that the Mariupol woman owned 50% of two apartments in the city center, as a result of which he had a criminal plan to seize the house for its further sale. To this end, the intruder offered the woman assistance in transferring ownership of the property to her son.
In the future, abusing the trust of the victim, the defendant received a power of attorney from her, and also committed several more frauds with documents in order to have the right to freely dispose of other people's property.
On behalf of the defendant, but contrary to her interests, the offender sold her share of apartments, and appropriated the money in the amount of more than 236,000 hryvnias.
The pre-trial investigation lasted about a year. Despite the fact that the suspect, taking into account his legal experience, gave legitimacy to the illegal acts using legal documents, the police proved his guilt. At least five examinations were carried out, a number of interrogations were carried out. Thanks to the indisputable evidence obtained, the man could not escape responsibility.
Currently, the indictment under Part 2 of Art. 190 of the Criminal Code of Ukraine (fraud that caused significant harm to the victim) is sent to the court, which will put an end to this case. The maximum penalty that threatens the accused is up to three years in prison.
Both apartments, which became the subject of criminal encroachment, were arrested.
