The Ministry of Internal Affairs signed a Memorandum of Assistance to Victims of Unfair Actions of the Liquidated Bank “Arkada” - Arsen Avakov
Today, April 7, the Ministry of Internal Affairs of Ukraine, the National Bank of Ukraine, the Security Service of Ukraine, the Kyiv City State Administration, the Deposit Guarantee Fund, the Ministry of Development of Communities and Territories and other parties signed a Memorandum on assistance to victims of unscrupulous actions of the liquidated bank “Arkada”. This was stated by the Minister of Internal Affairs of Ukraine Arsen Avakov during a briefing to the NBU.
“The problem with the development of the bank “Arcade” has existed for a long time. Taking into account the imperfect legislation currently in force in the country, I welcome the initiative of the people's deputies who are currently working to improve it so that there are no problems with deceived investors in the future. We have now signed a Memorandum that we have been working on for over a year. The issue is fundamentally resolved, we have worked out the way to solve this issue. However, it takes time to realize all the plans. Our task, including is to monitor the implementation of this Memorandum,” Arsen Avakov said.
The Ministry of Internal Affairs of Ukraine, within the framework of the Memorandum, undertook to ensure public order and security, as well as to conduct a full and impartial pre-trial investigation of criminal proceedings carried out by the National Police on the facts of appropriation of funds of Arkada Bank.
The Minister of Internal Affairs recalled that the police detained the founder of the bank “Arcada” Konstantin Palyvov and declared him a suspect.
“Law enforcement agencies are working to punish dishonest employees and the founder of Arcade. The investigation is ongoing. The guilty will be punished. While the investigation is underway, we will not disclose much information. However, when the details of the case appear that need to be told to the public, the National Police will definitely voice them,” Arsen Avakov stressed.
NBU Chairman Kirill Shevchenko recalled that in June 2020, the National Bank declared Arkada Bank bankrupt due to capital problems. No impact on the functioning of the banking system resulted, the bank's share in the market was not significant.
“The case of “Arcade” is much wider than the problems of a single small bank. This is another reminder of unregulated legal construction in our country. That is why the NBU, in cooperation with the Government, MPs, law enforcement and the involvement of public organizations, is developing a number of draft laws to continue signing the Memorandum,” Shevchenko stressed.
Mayor of Kyiv Vitaly Klitschko thanked all parties involved for the large-scale work done and told who will be engaged in the completion of residential complexes.
“As we promised, we offer a real algorithm for completing the construction of the bank “Arcade”. I would like to sincerely thank all parties for their joint work. I am convinced that we are ready to present the roadmap, which is set out in the Memorandum. This will allow people to finally get their housing. The developer collected more than 13 billion hryvnias of investments, and people never received their apartments. According to the Memorandum, “Capital of Groups” LLC will complete the residential complexes “Eureka”, “Patriotika” and “Patriotika on the Lakes”. The completion of the construction will be financed through the accounts receivable of financing the construction of the Arkada group of companies, as well as funds on the accounts of this bank and the sale of unrealized apartments,” Vitaly Klitschko said.
The head of the Security Service of Ukraine Ivan Bakanov expressed hope that all further problems that may arise from deceived developers will be solved by joint efforts.
Svitlana Recrut, the head of the Deposit Guarantee Fund, noted that there are currently two court decisions that oblige Arkada Bank to transfer documents and all cases to the new manager.
“After the full transfer of these documents, the new manager will receive full rights and obligations, and will be able to fulfill all obligations. Within a month, the remaining 10% of cases will be transferred. In addition, the Deposit Guarantee Fund has already paid more than 70% of the total amount to the depositors of the bank “Arkada”, - said Svetlana Recrut.
