Nikolaev investigators handed over suspicion of illegal mining to the head of the enterprise
By his illegal activity, the defendant caused losses to forestry of more than one and a half million hryvnias.
The director of one of the private joint-stock companies of the Voznesensky district is suspected of unauthorized occupation of part of the land plot of the State Forest Fund, violation of the established rules for the use of subsoil, which created a danger to the environment, as well as abuse of authority, which caused serious consequences under the law protected by law interests and interests of the state.
In the course of the pre-trial investigation, it was established that during 2013-2015, during the period of the absence of land allocation for the extraction of minerals of local importance, the offender voluntarily occupied the land plots of the Pribuzh forestry with a total area of about 8.3 hectares, located on the territory of the Buzka village council of the Voznesensky district of the Mykolaiv region. And the officials of the private joint-stock company damaged and destroyed the existing forest and vegetation cover on the lands of the said forestry, removed the ground cover without special permission, on which they mined minerals — sand, which caused losses to forestry by one and a half million hryvnia.
Investigators-detectives of the Department for the Investigation of Particularly Serious Crimes of the Investigative Department together with the employees of the Department for the Protection of Public and State Interests of the GUNP in the Nikolaev area under the procedural guidance of the Prosecutor's Office announced to the attacker a notice of suspicion immediately under three articles of the Criminal Code of Ukraine: under Part 2 Art. 364-1 “Abuse of powers by an official of a legal entity of private law, which caused serious consequences for the public interest”, part 1 of Art. 197-1 “Unlawful occupation of a land plot that caused significant harm to its rightful owner or owner” and according to Part 2 of Art. 240 “Illegal mining of minerals of national importance”.
Pre-trial investigation in criminal proceedings is ongoing. Sanctions of incriminating articles provide for up to six years imprisonment with deprivation of the right to hold certain positions or engage in certain activities for a period of up to three years.
