To the attention of residents of the temporarily occupied territories of Ukraine

From tomorrow, administrative measures will not be applied at the border to persons who, for humanitarian reasons, violated the procedure of entry/exit from (to) the TOT of Ukraine.

Today, the Law of Ukraine No. 1583 has been officially published, which enters into force tomorrow - July 24, 2021.

The law provides that Ukrainian citizens residing in the temporarily occupied territories of Ukraine are not subject to administrative penalties and measures of influence for administrative offenses related to violation of the procedure of entry and exit for the period of quarantine or during the blocking of the activity of entry-exit checkpoints. the occupied territory of Ukraine or departure from it, if such violations occurred on the grounds of a humanitarian nature determined by the Cabinet of Ministers of Ukraine.

We emphasize that the Law does not allow crossing the Ukrainian border at temporarily closed checkpoints and does not exempt from liability all persons who violated the procedure for entering or leaving the temporarily occupied territory of Ukraine. For this violation, Article 204-2 of the KuPAP provides for the imposition of a fine of one hundred to three hundred non-taxable minimum incomes of citizens (1700-5100 hryvnias). From tomorrow, administrative measures will not be applied to citizens who have committed the relevant violations on humanitarian grounds.

THE GROUNDS OF A HUMANITARIAN NATURE ARE:

- serious illness, death of close relatives;
- provision of medicines and medical devices or undergoing treatment in the presence of severe and/or chronic diseases (in particular, insulin-dependent diabetes, cancer, the need for antiretroviral, anti-tuberculosis therapy); - departure from temporarily the acquired territories of a person who has documents confirming the right to permanent or temporary residence in a state other than the Russian Federation; - registration of identity documents for the child and

confirm the citizenship of Ukraine (accompanied by one of the parents (adoptive parents), guardians, guardians or other legal representatives or accompanied by other persons authorized by one of the parents (adopters), guardians, guardians or other legal representatives); - visit an educational institution for training, passing vocational training, state final certification (in particular in the form of external independent assessment), qualification certification of vocational (vocational) education applicants, entrance tests, etc. (
the basis also applies to persons accompanying applicants for education); - family reunification;
- return of the person to his place of residence (exemption from liability is carried out once);
- for the purpose of accepting the inheritance.

The humanitarian grounds are defined by the documents approved by the Decisions of the Cabinet of Ministers of Ukraine dated 17.07.2019 № 815, dated 04.06.2015 № 367. This list is not exclusive and other cases may be taken into account where there is reason to believe that the situation requires the immediate departure or entry of a person from/to the temporarily occupied territory for humanitarian reasons or in order to prevent the occurrence of a threat to the life and health of the person and/or exercise of his/her rights (in particular in case of political persecution of a person in the temporarily occupied territories; retirement age of a person (in accordance with the legislation of Ukraine); disability (of any group); maintenance of two or more minors or persons with disabilities; necessity of registration (re-registration) of passport documents, pasting of age photos; the need for registration of a pension by age or disability).

We recommend that persons who violated the procedure of departure or entry from/to the temporarily occupied territory of Ukraine on humanitarian grounds, carry documents confirming these grounds with them during the border control.
