On leaving without consideration of the application for a license

The Ministry of Internal Affairs of Ukraine received an application from the limited liability company “TACTIKA” (hereinafter referred to as the company) about obtaining a license to conduct a type of business activity.

Based on the results of consideration of the application, it was established that there were grounds for leaving it without consideration.

In accordance with the order of the Ministry of Internal Affairs of Ukraine dated March 31, 2017 No. 282, the company received a license to carry out repair activities for non-military firearms, cold weapons, pneumatic weapons with a caliber of more than 4.5 mm and a bullet flight speed of more than 100 m/s, trade in non-military firearms, ammunition for it, cold weapons, pneumatic weapons of caliber over 4.5 mm and a bullet flight speed of more than 100 m/s; sale of special equipment loaded with tear and irritant substances, personal protection, active defense (place of activity at the address: Volodymyr Sosyury Street, building 7, Kyiv city).

Pursuant to paragraph 5 of the License Conditions for the conduct of economic activities for the production and repair of non-military firearms and their ammunition, cold weapons, pneumatic weapons with a caliber of more than 4.5 millimeters and a bullet flight speed of more than 100 meters per second, trade in non-military firearms and military accessories for it, cold weapons, pneumatic weapons with a caliber of more than 4.5 millimeters and a bullet flight speed of more than 100 meters per second; production of special devices charged with tear and irritant substances, personal protection, active defense and their sale, approved by the Resolution of the Cabinet of Ministers of Ukraine dated December 02, 2015 No. 1000 (hereinafter — License Terms), in case of opening of a place of business activity, the licensee submits to the licensing authority a notice of opening a place of activity (Appendix 14) and the documents provided for in subparagraphs 1 3 of this item.

In the information provided by the company on the availability of places of conducting business activities for low-mobility groups of the population (Appendix 13) and on places of conducting business activities (Appendix 11), the entry in the column “Place of conducting business activities” does not meet the requirements of paragraph 41 of the License Conditions.

In addition, the information about the places of business activity indicates all the places where the licensee carries out economic activities.

It is possible to eliminate these shortcomings by providing a notice on the opening of the place of conduct of activities (Appendix 14), as well as providing information on the availability of places of conducting business activities for low-mobility groups of the population (Appendix 13) and on places of conducting business activities (Appendix 11) in accordance with the requirements of the License Conditions.

In accordance with paragraphs 1 and 2 of the second part of Article 12 of the Law of Ukraine “On Licensing of Business Activities”

I ORDER:

1. Leave without consideration the application of the limited liability company “TACTIKA” (Tupoleva Street, building 19, Kyiv city, 04128, identification code 40905278) dated July 25, 2022 No. 39319 on obtaining a license for conducting business activities for the repair of non-military firearms, cold weapons, pneumatic weapons caliber over 4.5 mm and bullet flight speed over 100 m/s, trade in non-military firearms, ammunition for it, cold weapons, pneumatic weapons of caliber over 4.5 mm and bullet flight speed over 100 m/s; sale of special means charged with substances of tear and irritant action, personal protection, active defense.

2. Department of Communications (Andreev D.) to ensure that the order is placed on the official web portal of the Ministry of Internal Affairs for publication no later than the working day following the day of adoption of this decision.

3. The licensing department (Chubayevsky V.) to ensure control over the execution of this order.
