Order of the Ministry of Internal Affairs of Ukraine of May 22, 2020 No. 408 “On Amendments to the Order of the Ministry of Internal Affairs of Ukraine of December 07, 2009 No. 515” (hereinafter — Order No. 408), registered in the Ministry of Justice of Ukraine on July 06, 2020 under No. 625/34908.

3. Objectives of the adoption of the act

The purpose of developing the order is to improve the process of taking exams for obtaining the right to drive vehicles and issue driver's licenses.

The achievement of the goal was realized by:

coordination and introduction of legal norms defined by the Instruction on the procedure for passing exams for obtaining the right to drive vehicles and issue driver's licenses, approved by the order of the Ministry of Internal Affairs of Ukraine dated December 07, 2009 No. 515, registered with the Ministry of Justice of Ukraine on January 22, 2010 under No. 74/1717 369, in accordance with the requirements of the legislation;

specification of procedures for obtaining and exchanging driver's licenses;

recognition of documents on professional (vocational) education of the state model issued by institutions licensed to conduct educational activities in the field of vocational (vocational) education, documents certifying the training and retraining of drivers of vehicles;

settlement of gaps associated with the return of a driver's license to persons deprived of the right to drive vehicles;

establishing the procedure for the use of technical means of control during the preparation of exams, the preservation of the information obtained through them and access to it.

6. Methods for obtaining tracking results

Tracking the effectiveness of the order was carried out by analyzing and calculating statistical data on the number of trained candidates for a driver by institutions that train, retrain and improve the qualification of drivers of vehicles (hereinafter - institutions), as well as the number of issued, exchanged and returned by territorial bodies for the provision of service services of the Ministry of Internal Affairs driver's license.

7. Data and assumptions based on which performance was tracked, as well as ways of obtaining data

The results of tracking the specified regulatory order were obtained on the basis of the analysis of data obtained from the Unified State Register of the Ministry of Internal Affairs.

8. Quantitative and qualitative values of indicators of the effectiveness of the act

For the tracking, the indicators that were determined during the preparation of the regulatory impact analysis were used:

the number of business entities and/or natural persons covered by the act;

The action of the regulatory act applies to all business entities that train, retrain and improve the qualification of drivers of vehicles.

As of December 01, 2021, the Unified State Register of the Ministry of Internal Affairs has accumulated information on 1827 business entities that train, retrain and improve the qualification of drivers of vehicles;

the amount of revenues to the state and local budgets and state appropriations related to the action of the act

The regulatory act does not provide for revenues to the state and local budgets and state appropriations funds.

the amount of funds and time spent by business entities and/or individuals related to the fulfillment of the requirements of the act

the level of awareness of business entities and/or individuals on the main provisions of the act

A high level of awareness was ensured by posting order No. 408 on the official website.

In addition, according to the results of data analysis for the reporting period (from January 23, 2021 to December 01, 2021):

institutions have prepared candidates for driver - 593 119;

territorial bodies for the provision of service services of the Ministry of Internal Affairs issued driver's licenses — 968 791;

territorial bodies for the provision of services of the Ministry of Internal Affairs exchanged driver's licenses — 445 777.

9. Evaluation of the results of the implementation of the regulatory act and the degree of achievement of the specified goals

The regulatory act provides, in particular, the specification of the procedures for obtaining and exchanging driver's licenses, the recognition of documents on professional (vocational) education of the state model issued by institutions licensed to conduct educational activities in the field of vocational (vocational) education, documents certifying the training and retraining of drivers vehicles, settlement of gaps associated with the return of a driver's license to persons deprived of the right to drive vehicles, establishing the procedure for using technical means of control during the preparation of exams, storage of information obtained through them and access to it.

It will be possible to draw a conclusion about the assessment and degree of implementation of the regulatory act when comparing indicators of repeated and periodic performance tracking.
