Abuse of the “Way” system: 38 carriers denied access and more than 60 criminal proceedings opened

With the beginning of the war of the Russian Federation against Ukraine, border guards often stop attempts to illegally cross the border. One of the types of illegal activity is the use by violators to cross the state border of the “Shlyakh” system for the purpose of further non-return to the territory of Ukraine.

The analysis carried out by the border service of the departure of drivers of vehicles of economic entities that have a license for the right to conduct economic activities on international transportation indicates some offenses. In particular, 1.5% of people who left Ukraine in January-February of this year under the “Way” system did not return to the country on time within the specified period of 60 days, which is established by the Border Crossing Rules for this category of persons.

This nature of offenses is observed among carriers from almost all regions of Ukraine, but most from Ternopil, Transcarpathian, Ivano-Frankivsk, Rivne and Lviv regions. At the same time, most of the abuses are noted by entrepreneurs, who, like large carrier enterprises, are given the opportunity to add individuals to the “Way” system. Large enterprises care more about their reputation, but individual entrepreneurs abuse the opportunities provided and for a monetary reward, approximately from 3 to 7 thousand US dollars, offer their services for entering data about individuals into the system. In some cases, a new enterprise is created to carry out illegal activities.

In view of such violations, the State Border Guard Service has strengthened measures aimed at establishing legal grounds for crossing the state border by persons entered into the “Way” system.

As a result, more than 4.3 thousand people since the beginning of the year have been refused to leave Ukraine, who followed as drivers of business entities. Also this year, the Border Agency of Ukraine sent 100 information letters to Ukrtranssecurity on detected violations by licensees who entered into the “Shlyakh” system information about drivers who left Ukraine and did not return to Ukraine within 60 days specified by law. In general, since the beginning of the action system “Path” already 38 licensees have temporarily suspended access to the system.

Also at this time, documentation of the specified criminal activity in the framework of more than 60 criminal proceedings under Art. 332 Criminal Code of Ukraine (illegal transfer of persons across the state border of Ukraine). In addition, 126 persons were notified of suspicion of committing a crime and 4 persons were convicted.
