Under what circumstances and what category of officials and employees of state bodies can go abroad

During the martial law, the possibility of traveling abroad for a number of representatives of state authorities, state bodies, local self-government bodies and certain business entities is limited.

The relevant requirements are introduced by the Resolution of the Cabinet of Ministers of Ukraine dated 27.01.2023 No. 69 to the Rules for Crossing the State Border by Citizens of Ukraine, approved by the Resolution of the Cabinet of Ministers of Ukraine dated January 27, 1995. № 57.

The amendments provide for the departure abroad of government officials, people's deputies and deputies of local councils, judges, prosecutors, a number of officials of other state bodies, employees and other categories of persons specified in paragraph 1. 2-14 Rules for crossing the border, can be carried out exclusively during the business trip https://www.kmu.gov.ua/npas/pro-vnesennia-zmin-do-pravyl-peretynannia-derzhavnoho-kordonu-hromadianamy-s69-270123.

The Government also obliged ministries, central and local executive bodies, other state bodies and local self-government bodies and business entities to submit to the Administration of the State Border Guard Service and update the lists of such persons.

The changes also provide for cases when the passage through the border of such persons may not be carried out during the period of an official business trip.

Such circumstances include the possibility of visiting or accompanying women and men who are single parents, children abroad, the need for treatment abroad or the death of a family member outside Ukraine. The pass is carried out by authorized persons of the State Border Guard Service in the presence of relevant supporting documents.

Please note that mothers or single parents from among the listed categories may visit their children under the age of 18 abroad, or be accompanied by them, in accordance with paragraph 2 of paragraph 2-14 of the said Decree.

Thus, during the departure of women outside Ukraine in order to visit children who are outside Ukraine, in addition to the passport document, you must have a birth certificate of the child (children) and documents (their notarized copies) confirming the stay of children outside Ukraine. Among them may be: stay in consular registration, study stay, stay in treatment, etc.

For men, in addition to the documents specified for women, for travel to children there must be documents confirming the status of a single father, the upbringing and maintenance of the child by the father independently (death certificate of the child's mother, court decision on deprivation of parental rights, court decision on recognition of the missing mother, court decision on the declaration of maternity and died).

Also, in order to travel abroad of a certain category of persons for the purpose of treatment, it is necessary to submit documents giving the right to leave Ukraine and enter our country, and a letter from the Minister of Health about the list of persons agreed with the foreign party that health institutions of foreign countries can accept for treatment abroad.
