Committed a conflict with police officers when compiling administrative materials for violation of traffic rules
The actions of the defendants are qualified as a threat or violence against a law enforcement officer. In addition, administrative protocols have been drawn up for these citizens under Art. 185 (malicious disobedience to a legal order or a police officer's demand) and to the driver of the car - under Art. 121 (Violation of the rules for driving or operating a vehicle, rules for the use of seat belts or motorcycle helmets) KUPap.
12 July at 21:23, patrolling the m. Chigirin, on the street of Hetmanskaya, police officers noticed a Dodge Journey car, which was moving with an unlit license plate in the dark. For violation of traffic rules, police officers stopped the vehicle.
During the registration of administrative materials in relation to the driver, a passenger came out of the car, who in the presence of a minor child began to behave aggressively and make obscene remarks. At the same time, he did not respond to the remarks of law enforcement officers. When he began to grab the policeman by the uniform, the driver of the car joined in the commission of illegal actions.
In view of this, in accordance with Art. 44, para. 1 and 3 part 3 of Art. 45 of the Law of Ukraine “On the National Police”, the police used a means equipped with substances of tear and irritant action, as well as measures of physical impact and shackles. During the arrest, the passenger of the specified car inflicted bodily harm on the police officer.
At this moment, relatives of the detainees came to the scene. All these events are recorded on the police officer's DVR and chest cameras.
According to this fact, the Cherkasy district police department of the GUNP in the Cherkasy region opened criminal proceedings under Part 2 of Art. 345 (Threat or violence against a law enforcement officer) of the Criminal Code of Ukraine.
In addition, administrative protocols have been drawn up for these citizens under Art. 185 (malicious disobedience to a legal order or a police officer's demand) and to the driver of the car — under Art. 121 (Violation of the rules for driving or operating a vehicle, rules for the use of seat belts or motorcycle helmets) KUPap.
