Private gas trader caused losses of more than UAH 37 million to NJSC “Naftogaz of Ukraine”: National police exposed fraudulent scheme
Four officials of a private trading company that failed to fulfill the obligation to supply gas were declared suspected of causing property damage to JSC “NJSC “Naftogaz of Ukraine”, official counterfeiting and legalization of funds obtained by criminal means.
The activities of the criminal group were documented by the investigators of the Main Investigative Department of the National Police of Ukraine with the prompt support of the employees of the Security Service of Ukraine and the procedural guidance of the Office of the Prosecutor General.
In the course of the investigation, it was established that the officials of the specified legal entity of private law — a participant in the gas market, entered false information in the relevant commercial acts for February and March 2021 on the supply of natural gas to the heat generating company.
With the aim of seizing the company's funds, the defendants did not ensure the fulfillment of their obligations and did not supply it with natural gas during the heating season.
In this way, they seized the company's funds worth over UAH 37.2 million and legalized them through controlled entities.
In order to provide hot water supply and heating of premises, gas supply to the heat-generating enterprise was carried out by the state company JSC “NAK “Naftogaz of Ukraine”, which guarantees such a service to consumers in the absence of a supplier.
The police informed four persons of the private gas trader enterprise about the suspicion of committing the crimes provided for in Part 1 of Art. 366 (Service forgery), part 5 of Art. 191 (Appropriation, squandering of property or possession of it by abuse of official position, part 2 of Art. 209 (Legalization (laundering) of property obtained by criminal means) of the Criminal Code of Ukraine.
The investigators applied to the court with a request for the selection of the suspects, including the company's management and co-founders, a precautionary measure in the form of detention. For committing these crimes, offenders face up to 12 years in prison with confiscation of property.
