Features of crossing the border during the operation of the legal regime of martial law

We remind you that the rules for crossing the state border by citizens of Ukraine provide for certain peculiarities of passage during martial law.

As previously reported, in order to implement measures of the legal regime of martial law, the travel abroad
of male citizens of Ukraine aged 18 to 60 years is limited. At the same time, such a ban is not absolute. It does not apply to persons who are excluded from military registration for health reasons, have disabilities, who permanently reside or study at universities abroad, as well as a number of other categories. We also remind that due to humanitarian circumstances and according to previously reached agreements with neighboring countries, border guards can pass citizens of Ukraine also on the internal passport document. This decision was made in view of the situation on the territory of Ukraine during the martial law, when citizens of Ukraine cannot quickly and timely issue a passport of a citizen of Ukraine for traveling abroad (foreign passport). At the same time, the State Border Guard Service draws the attention of citizens of Ukraine that in some cases, during their stay abroad, there may be an urgent need to have a passport, which is determined by the laws of the countries where our compatriots plan to stay, or during trips between different countries. Therefore, we advise citizens of Ukraine to take into account all different situations and, if possible, to get a passport before crossing the border.

Separately, we recall that the Rules for crossing the state border by citizens of Ukraine are regulated by the Resolution of the Cabinet of Ministers of Ukraine dated January 27, 1995 No. 57.

Among other things, it determines that during the period of the legal regime of martial law, it is possible to leave children under 16 years of age accompanied by one of the parents, grandmother, grandfather, adult brother, sister, stepmother, stepfather or other persons authorized by one of the parents by a written statement certified by the guardianship authority and guardianship, without the notarized consent of the second parent and in the presence of a passport of a citizen of Ukraine or a birth certificate of a child (in the absence of a passport of a citizen of Ukraine) /documents containing personal information on the basis of which the State Border Guard Service will allow crossing the state border.
