$10.5 thousand for sentence mitigation: judges of Kropyvnytskyi Court of Appeal declared suspicion
We are talking about replacing the real punishment for committing an accident with fatal consequences for a suspended term.
In order to hide the corruption activity, the judge involved an intermediary who conducted all the negotiations and discussed the details of the “deal”. For $10,500 in illegal benefits, a representative of the judicial branch promised to resolve the issue of the decision by the panel of judges in favor of the defendant: instead of three years in prison — a suspended term.
During the investigation, DSR operatives of the National Police and NABU detectives under the procedural guidance of the SAP documented the fact that the judge received an unfair advantage.
On the basis of the collected evidence, the judges of the Kropyvnytskyi Court of Appeal reported the suspicion of the fact of receipt by an official of improper benefits — Part 3 of Art. 368 of the Criminal Code of Ukraine, and to the intermediary — according to Part 5 of Art. 27 Part 3 of Art. 368.
The sanction of the article provides for punishment in the form of imprisonment for up to ten years with deprivation of the right to hold certain positions or engage in certain activities for up to three years, with confiscation of property.
