Strengthening cooperation in countering cyberterrorism and other mass attacks on the Internet

Parliamentary Assembly

1. The Parliamentary Assembly refers to its Resolution No. 2070 (2015) on strengthening cooperation in countering cyberterrorism and other mass attacks on the Internet.

2. It underlines the importance of the Council of Europe in addressing the global challenge related to the security of computer networks, in connection with the emergence of cyberterrorism and other mass attacks operating on and through computer systems, posing a serious threat to national security, public security and well-being of countries.

3. The Assembly recommends to the Committee of Ministers:

3.1 to invite the Parties to the Convention on Cybercrime and its Additional Protocol on Cybercrime on the criminalisation of racist and xenophobic acts committed through computer systems (ETS No. 185 and 189) to investigate whether:

3.2 a draft supplementary protocol setting out the overall level of criminalisation of mass cyber attacks, including the aggravating circumstances of such attacks, as well as minimum standards for punishment for such attacks;

3.3 a draft other additional protocol on mutual assistance with regard to investigatory powers, defined in particular in the content and application of Article 32 of the Convention, in accordance with the relevant Directive Memorandum of the Convention Committee on Cybercrime represented by the Parties to the Convention;

3.4 invite the Cloud Evidence Collection Group established under the Cybercrime Convention Committee to explore the possibility of developing an additional protocol to the Convention on Cybercrime on access to the cloud server database in criminal proceedings;

3.5 draft legal standards on the international responsibility of States regarding the use of all appropriate measures to prevent mass cyberattacks that have been carried out by persons who, in turn, fall under their jurisdiction or from the territory of their State fight against the computer systems of another State;

3.6 Increase assistance and monitoring of actions for the implementation of the Convention on Cybercrime in accordance with domestic legislation and practices, as well as practical measures and cooperation in the fight against mass cyberattacks, in particular in favour of Member States facing difficulties in implementing the Convention on Cybercrime in practice crime;

3.7 Call upon Austria, Bosnia and Herzegovina, the Czech Republic, Greece, Hungary, Iceland, Ireland, Italy, Malta, Monaco, Portugal, San Marino, Sweden and the United Kingdom to sign and/or ratify without further delay the 2003 Protocol. amending the European Convention against Terrorism (ETS Nos. 90 and 190) necessary for the entry into force of this Protocol;

3.8 transmit to their competent ministries and authorities this Recommendation and Resolution 2070 (2015) on strengthening cooperation in countering cyberterrorism and other mass attacks on the Internet.
