Prerequisites for the creation of
the system Today in our state there has been a catastrophic situation in the field of road safety. The scale of road traffic injuries in Ukraine is significantly ahead of similar indicators in most countries of the world. According to available statistics, on average in Ukraine every day 9 people die as a result of an accident, 90 people suffer bodily injuries. One of the main causes of traffic accidents is exceeding the maximum permissible speed of the vehicle
Despite all the warnings, objections and disapproval of this system by individual politicians and representatives of the public, the most effective, effective and non-alternative mechanism for controlling the speed regime on the roads of the state will be the introduction of a system of automatic detection of violations of traffic rules. Today, such a system works in most countries of the European Union and developed countries of the world, and their experience shows that the introduction of this system has radically changed the road safety situation for the better. For example, in neighboring Poland, after the introduction of the system of automatic fixation of violations of traffic rules, the number of accidents in the state decreased by 30%!
Operation of the system of autofixation and placement of control devices
The system for fixing administrative offenses in the field of ensuring road safety in automatic mode (hereinafter — the System) at this time fixes such violations of the Rules of the Road, as exceeding the established speed limits of vehicles and violations of traffic rules and stops in the lane for route vehicles.
Fixation of offenses is carried out by automatic fixation complexes - stationary technical means (control devices) that allow automatic detection and photography or video recording of events containing signs of administrative offenses in the field of road safety.
The introduction of stationary technical means (control devices) on public roads of public use is entrusted to the owners of such roads, on public roads of local importance, streets and roads in cities and other settlements — to local self-government bodies. Such devices are placed in emergency dangerous places (sections) and/or places (sections) of concentration of traffic accidents on public roads of state importance, on public roads of local importance, on streets and roads of cities and other settlements.
Places of installation of stationary technical means (control devices) shall be agreed in writing with the relevant authorized body of the National Police.
The Department of Patrol Police of the National Police of Ukraine is determined by the authorized body of the National Police of Ukraine to impose administrative penalties in cases of administrative offenses in the field of road safety, recorded in automatic mode.
In accordance with the requirements of the Rules of the Road in settlements, the speed of movement is not more than 50 km/h, and in places where road conditions are created that make it possible to move at a higher speed, the permitted speed, by decision of road owners in agreement with the National Police, can be increased. On highways outside settlements, the speed of movement of vehicles is allowed - no more than 90 km/h, on highways with a dividing strip - no more than 110 km/h, on highways - no more than 130 km/h.
When issuing a decision for exceeding the established speed limits of vehicles by 20 km/h, fixed in automatic mode, the permissible error, which is laid down in the control device, is taken into account, but not more than ±3 km/h.
For example, in the city of Kiev, the movement of vehicles is allowed at a speed of not more than 50 km/h. During the measurement, the maximum error of the control devices currently operating in the city, which is ±2 km/h, is taken into account. So, in the case of fixing by a complex of automatic fixation of the vehicle speed of more than 72 km/h (50+20+2), that is, if the speed indicator of the vehicle is 73 km/h or more, a fine will be imposed.
According to the decision of the Kyiv City State Administration from April 1 to November 1, vehicles are allowed to travel at a speed of 80 km/h on the relevant roads of Kyiv (for example, Bazhana Avenue in the direction of Boryspil). So, in the case of fixing by the automatic fixation complex of the vehicle speed of more than 102 km/h (80+20+2), that is, if the speed indicator of the vehicle is 103 km/h or more, a penalty in the form of a fine will be imposed.
After the event is fixed by the System, the information will be sent to the data center for automatic fixation of violations of the Traffic Rules of the Department of Patrol Police, where it is considered by the authorized police officer, taking into account the information obtained from the relevant databases (registers) necessary for issuing a decision on the imposition of an administrative penalty offenses in the field of traffic safety, recorded in automatic mode.
Administrative responsibility for traffic safety violations recorded in automatic mode is borne by the responsible person:
- an individual or the head of the legal entity under which the vehicle is registered; - the proper user of the relevant vehicle, if the relevant data is entered in the Unified State Register of Vehicles
If the vehicle is registered outside the territory of Ukraine, the person who imported such a vehicle into the territory of Ukraine is brought to administrative responsibility. The decision can be made without the participation of the person who is brought to administrative responsibility. The decision on the imposition of an administrative penalty, which has not been executed by paying 50 percent of the fine within ten days from the date of its issuance, is printed and sent to the responsible person by registered mail with a notification to the address of the place of registration (residence) of the individual (location of the legal entity) or handed over to the person, which imported the vehicle (foreign registration) into the territory of Ukraine, by the relevant units of the State Border Service of Ukraine. The resolution comes into force after its delivery to a person or receipt of a postal notice of delivery or refusal to receive it, or the return of the postal item with a mark of non-delivery or after payment of 50 percent of the fine (in the period from the date of the decision to the expiration of 10 days from the date of delivery of such a resolution or receipt of a postal notice of delivery, or refusal to receive it, or return the postal item with a mark of non-delivery).

What needs to be done
by the owner if the car is not driven by him Taking into account the peculiarities of imposing a penalty when considering cases of administrative offenses in the field of road safety, recorded in automatic mode, it is recommended to timely enter information about the appropriate user into the Unified State Register of Vehicles through: - territorial bodies for the provision of service services in the city The Ministry of Internal Affairs; - web application, located on the official website of the Main Service Center of the Ministry of Internal Affairs.
In the event that a Resolution has already been issued in relation to the responsible person or the person who imported the vehicle into the territory of Ukraine, the law provides for exemption from administrative responsibility, if within 20 calendar days from the date of the commission of the relevant offense, or from the date of entry into force of the Decree: - the person who drove the transport by means at the time of the commission of the said offense, appealed personally to the authorized unit of the National Police, with a statement of recognition of the said fact of administrative offense
and consent to administrative liability, and provided a document (receipt) on payment of the corresponding fine.
The application can also be submitted through the official website of the Ministry of Internal Affairs, subject to electronic identification of the person using a qualified electronic signature.
Payment of the fine or appeal of the decision
To make the payment of the fine, you can follow the link on the QR code indicated on the front side of the Resolution, use the payment tools on the official website of the Ministry of Internal Affairs (at https://bdr.mvs.gov.ua/), in the driver's electronic account or in the “Action” application, as well as payment systems and services operating in Ukraine on legal grounds, including the services of banks of Ukraine. According to the KUPAP, exceeding the established speed limits of vehicles by more than 20 km/h entails the imposition of a fine in the amount of 340 UAH, and in case of exceeding the established speed limits of vehicles by more than 50 km/h — 1700 UAH.
In case of payment of a fine in the period from the date of the decision to the expiration of 10 days from the date of delivery of such a decree or receipt of a postal notice of delivery, or refusal to receive it, or return the postal item with a mark of non-delivery, the payment will be 50% of the total amount, and the resolution will be considered completed. The total term of payment of the fine is 30 days from the date of entry into force of the decision. A complaint against the Resolution may be filed within ten days from the date of entry into force of the Decree to a higher body (a higher official) or to a district, district court in the city, city or city district court, in the manner prescribed by the Code of Administrative Procedure of Ukraine. Funds from fines for violations of traffic rules, which are recorded in automatic mode, will be directed exclusively in two directions: — financing and improvement of road infrastructure and road safety.

The procedure for delivery and non-delivery of the Resolution The day of receipt of the Resolution is the date specified
in the postal notice of its delivery to the responsible person or adult family member of such person. If the responsible person refuses to receive the Resolution, the day of receipt of the Resolution shall be the day of affixing a mark in the postal message about the refusal to receive it. In case of non-delivery of the Resolution to the addressee, the day of receipt of the decree shall be the day of return of the postal item with a mark on non-delivery to the data center for automatic fixation of violations of the Traffic Rules of the Department of Patrol Police. Decisions, which are issued in relation to persons who have imported vehicles (foreign registration) into the territory of Ukraine, are handed over at the crossing of the state border of Ukraine by representatives of the units of the State Border Service of Ukraine.
