Report on re-tracking the effectiveness of the order of the Ministry of Internal Affairs of Ukraine dated August 28, 2019 № 736 “On Approval of the Procedure for Keeping a Register of Subjects of Mandatory Technical Control”

1. Type and name of the regulatory act

Order of the Ministry of Internal Affairs of Ukraine dated August 28, 2019 No. 736 “On Approval of the Procedure for Keeping a Register of Subjects of Mandatory Technical Control”, registered with the Ministry of Justice of Ukraine on September 18, 2019 under No. 1036/34007 (hereinafter — the regulatory act).

 

2. Name of the retracking event executor

Ministry of Internal Affairs of Ukraine.

 

3. Objectives of the adoption of the act

The main purpose of the adoption of the regulatory act is to introduce a clear procedure for actions of the Main Service Center of the Ministry of Internal Affairs (hereinafter — the GSC of the Ministry of Internal Affairs) as the administrator for maintaining the register of subjects of mandatory technical control (hereinafter — the register of the SOTC) and the specified procedure for entering data on the subject of mandatory technical control in the SOC register TC, taking into account the requirements of the current legislation regulating legal relations in the field of mandatory technical control of vehicles.

 

4th. Deadline for the implementation of measures to re-track the effectiveness of the regulatory act

In accordance with Article 10 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity”, re-tracking the effectiveness of a regulatory act is carried out one year from the date of its entry into force or entry into force of most of its provisions, but not later than two years from the date of entry into force of this act or most of its provisions, if the decision of the regulatory body that adopted this regulatory act did not set an earlier deadline. At the same time, re-tracking of performance is carried out three months before the expiration of the specified period, unless otherwise established by the decision of the regulatory body that adopted this act, but not later than the expiration date of the specified period.

The implementation of measures to track the performance of the act was carried out in the period from October 08, 2020 to September 17, 2021.

6. Methods for obtaining tracking results

The statistical method and data obtained by studying the performance indicators of the regulatory act were used to re-track the performance of the act.

 

7. Data and assumptions based on which performance was tracked, as well as methods of obtaining data

The results of tracking the regulatory act were obtained on the basis of the analysis of data on the information entered by the GSC of the Ministry of Internal Affairs about the OTC subjects in the SOTC register.

 

8. Quantitative and qualitative values of indicators of the effectiveness of the act

The implementation of the regulatory act did not require the allocation of additional funds to ensure the proposed regulation.

The publication and implementation of the regulatory act did not entail additional costs from the State Budget of Ukraine.

The action of the regulatory act applies to all business entities that check the technical condition of vehicles during the mandatory technical control of vehicles.

The action of the act did not lead to an increase in the cost of works or an increase in the duration of their execution for business entities associated with the fulfillment of the requirements of the act.

The level of awareness of business entities and/or individuals on the main provisions of the regulatory act is average and was ensured by placing an order on the official website of the Ministry of Internal Affairs of Ukraine at: http://www.mvs.gov.ua/.

In addition, for the period from October 08, 2020 to September 17, 2021, information about 238 OTC entities was entered in the SOTC register.

 

9. Evaluation of the possible results of the implementation of the regulatory act and the degree of achievement of the specified goals

Based on the results of re-tracking the effectiveness of the regulatory act, it can be concluded that its implementation established a qualitative and objective mechanism for actions of the Ministry of Internal Affairs GSC when entering data on the subject of OTC in the register of SOTC. In addition, the list and sources of information entered in the SOTC register are defined, which ensures the objectivity, timeliness and completeness of the entry of relevant information.
