Order No. 1054 of December 26, 2018 “On Amendments to Certain Regulatory Acts on the Transportation of Dangerous Goods”

3. Objectives of the adoption of the act

In accordance with the Procedure for the issuance and registration of certificates for the admission of vehicles to the transportation of certain dangerous goods, approved by the order of the Ministry of Internal Affairs of August 04, 2018 No. 656 “On approval of certain regulatory acts on the road transportation of dangerous goods”, to obtain/renew the vehicle permit certificate the owner of the vehicle, the carrier or the person authorized by him submits to the service center of the Ministry of Internal Affairs (hereinafter referred to as “SC”) to the service center of the Ministry of Internal Affairs (hereinafter referred to as “SC”) to the service center of the Ministry of Internal Affairs (hereinafter referred to as “SC”). in accordance with the purpose of the vehicle, as well as the specified mandatory documents, if the vehicle has built-in tanks (except mixing-charging machines with tanks with a capacity of less than 1000 liters), a copy of the valid certificate of the primary, intermediate, periodic and unscheduled inspection of the tank issued by the inspecting authority in accordance with the requirements of DOPNV.

The procedure for the inspection of tanks is determined by the order of the Ministry of Infrastructure of Ukraine, the Ministry of Internal Affairs of Ukraine dated May 12, 2015 No. 166/550 “On Approval of the Procedure for Inspection of Tanks for the Transportation of Dangerous Goods”, registered with the Ministry of Justice of Ukraine on June 05, 2015 under No. 663/27108.

At the time of adoption of the regulatory act, due to the small number of entities authorized to inspect tanks, a large number of vehicles with installed tanks carrying dangerous goods did not have the opportunity to check the tanks for their compliance with the established rules.

At the same time, the receipt of permits by entities that planned to provide tank inspection services needed additional time to complete the permit procedure and to be authorized as competent executors for the inspection of tanks installed on wheeled vehicles carrying dangerous goods.

In order to ensure the possibility for carriers to carry out the transport of dangerous goods until the authorisation of a sufficient number of economic entities carrying out tank inspections for the needs of such carriers, it was decided to postpone the mandatory inspection of tanks for carriers transporting dangerous goods in domestic traffic.

4. Term of implementation of measures for basic monitoring of the effectiveness of the regulatory act

The analysis of the regulatory impact before the act provided for the basic tracking of the performance of the act before the entry into force of this act by analyzing statistical data.

According to Article 10 of the Law of Ukraine “On the Principles of State Regulatory Policy in the Field of Economic Activity”, if only statistical data are used to determine the values of performance indicators of a regulatory act, basic performance tracking can be carried out after the entry into force of this regulatory act or the entry into force of most of its provisions.

Only statistical data were used to track the performance of the act, so the basic performance tracking was carried out after the entry into force of this regulatory act from June 01 to June 27, 2019.

6. Methods for obtaining tracking results

Tracking the effectiveness of the regulatory act is carried out by the method of quantitative and qualitative analysis of vehicles admitted to the transportation of dangerous goods, on which tanks (tankers and tanks, which are part of mixing-charging machines) are installed, by comparing statistical data.

7. Data and assumptions based on which performance was tracked, as well as methods of obtaining data

The results of tracking the regulatory act were obtained on the basis of the analysis of data obtained from the Unified State Register of Vehicles on the number of vehicles allowed to transport dangerous goods, on which tanks are installed (tankers and tanks, which are part of mixing-charging machines), by comparing statistical data.

8. Quantitative and qualitative values of indicators of the effectiveness of the act

The implementation of the regulatory act did not require the allocation of additional funds to ensure the proposed regulation.

The publication and implementation of the regulatory act did not entail additional costs from the State Budget of Ukraine.

The action of the regulatory act applies to all business entities that carry out the transportation of dangerous goods by vehicles on which tanks are installed (tankers and tanks, which are part of mixing-charging machines).

The action of the act did not lead to an increase in the cost of works or an increase in the duration of their execution for business entities associated with the fulfillment of the requirements of the act.

The level of awareness of business entities and/or individuals on the main provisions of the regulatory act is high and was ensured by posting a Government resolution on the official website of the Ministry of Internal Affairs of Ukraine.

The analysis of the quantitative performance indicators of the regulatory act was carried out from the date of entry into force of the regulatory act until June 01, 2019. The effectiveness of the regulatory act is reflected in the number of vehicles on which tanks (tankers and tanks, which are part of mixing-charging machines) are installed, allowed to transport specified dangerous goods, since the entry into force of the regulatory act until June 01, 2019, which amounts to 7364 vehicles.

As of June 01, 2019, 4 entities were authorized to inspect tanks, of which 2 were authorized during the period of validity of the regulatory act. During this period, the entities carried out an inspection of 3216 tanks for the transport of dangerous goods, which, first of all, ensured the uninterrupted activities of the entities transporting dangerous goods.

9. Evaluation of the possible results of the implementation of the regulatory act and the degree of achievement of the specified goals

Based on the results of the basic monitoring of the effectiveness of the regulatory act, it can be concluded that its implementation ensured the regulatory and legal regulation of the road transportation of dangerous goods through the territory of Ukraine, and also contributed to the improvement of conditions for carriers of dangerous goods.
