EXPLANATORY NOTE
to the draft order of the Ministry of Internal Affairs of Ukraine “On approval of the procedure for monitoring the technical condition of wheeled vehicles during their operation”, developed by the National Police of Ukraine.
1. Justification of the need to adopt the act
The specified regulatory act was developed in
accordance with the Laws of Ukraine “On Road Traffic”, “On Road Transport”, “On Transportation of Dangerous Goods”, as well as bringing the normative legal acts of the Ministry of Internal Affairs in accordance with the requirements of the Law of Ukraine “On National Police”. At the same time, the order of the Ministry of Internal Affairs of Ukraine of October 13, 2008 No. 534 “On approval of the procedure for monitoring the technical condition of wheeled vehicles during their operation”, registered with the Ministry of Justice of Ukraine on November 17, 2008 under No. 1107/15798, is recognized as invalid.
2. Purpose and ways to achieve it
The purpose of the adoption of the order is to increase the effectiveness of the activities of police officers in performing functions aimed at ensuring road safety and compliance by citizens with rules, norms and standards in the field of road safety.
3. Legal Aspects
1. In this sphere of legal regulation, the Code of Ukraine on Administrative Offenses, the Laws of Ukraine “On the National Police”, “On Road Traffic”, “On the Transportation of Dangerous Goods”, the Resolution of the Cabinet of Ministers of Ukraine dated October 10, 2001 No. 1306 “On Traffic Rules” apply.
2. The implementation of the order does not require amendments to other current legal acts of Ukraine, but recognizes the order of the Ministry of Internal Affairs of Ukraine dated October 13, 2008 No. 534 “On approval of the procedure for monitoring the technical condition of wheeled vehicles during their operation”, registered with the Ministry of Justice of Ukraine 17 November 2008 for No. 1107/15798, which has lapsed.
4. Financial and economic justification
The implementation of the order does not require additional financial costs from the state budget.
5. Position of the bodies concerned
The requirements of this order concern the interests of the National Police of Ukraine, the Ministry of Internal Affairs of Ukraine, the Ministry of Infrastructure of Ukraine, the State Environmental Inspectorate of Ukraine and the State Service of Ukraine on Food Safety and Consumer Protection.
6. Regional aspect
The order does not address the issue of development of administrative-territorial units.
6.1. Preventing Discrimination
There are no provisions in the order that contain signs of discrimination.
7. Prevention of corruption
The order does not contain rules and procedures that may contain the risks of committing corruption offenses.
The order does not require public anti-corruption examination.
8. Public discussion
The order does not require consultation with the public.
9. Position of social partners
The order does not apply to the social and labor sphere and labor relations.
10. Assessment of regulatory impact
The order is not a regulatory act.
