The Ministry of Internal Affairs of Ukraine conducts electronic consultations with the public on the draft order of the Ministry of Internal Affairs of Ukraine “On Amendments to the Order of the Ministry of Internal Affairs of Ukraine dated December 07, 2009 No. 515” (hereinafter — the draft order), published on May 18, 2023 in the subheading “Project Normative acts” heading “Normative base of the Ministry of Internal Affairs” of the official website of the Ministry of Internal Affairs of Ukraine: here.

Stakeholders to whom the draft order will apply:

• persons intending to pass theoretical, practical exams for obtaining the right to drive vehicles;
• authorized employees of territorial service centers of the Ministry of Internal Affairs (hereinafter referred to as the Central Committee of the Ministry of Internal Affairs), which, in accordance with their official duties, are assigned functions for passing exams.

The draft order provides for the presentation in the new edition of the Instruction on the use of technical means of control during the passing of exams (including with the help of photo and video equipment), the preservation of the information obtained by them and access to it, approved by the Order of the Ministry of Internal Affairs of Ukraine of May 22, 2020 No. 408, registered in the Ministry of Internal Affairs Justice of Ukraine of July 06, 2020 under No. 626/34909, according to which the relevant technical means of control during the passing of exams in real time will provide, in particular:

• photographing, video recording of data (parameters) of facial features of the person taking the exam and the examiner taking it;
• video and audio recording of the monitor screen of an automated workplace, on which a person passes a theoretical exam;
• video and audio recording of the road situation behind the vehicle on which the practical exam is taken, if the design of this vehicle allows them to be carried out;
• video and audio recording of the vehicle controls (steering wheel, gearshift lever, brake pedal, fuel control pedal, vehicle clutch pedal with manual transmission), on which the practical exam is taken;
• fixing the impact on the duplicate mechanisms of the controls of the vehicle brake system and the transmission of the vehicle with a manual transmission.

In addition, the draft order provides for an increase in the period during which a person who passed the exam in the Central Committee of the Ministry of Internal Affairs can receive a copy of the photographic image, video and audio recording of the examination process, in particular, from three working days to thirty calendar days.
