The Ministry of Internal Affairs of Ukraine conducts electronic consultations with the public on the draft resolution of the Cabinet of Ministers of Ukraine “On Amendments to the License Conditions for the Conduct of Economic Activities for the Production and Repair of Non-Military Firearms and Ammunition for It, Cold Weapons, Pneumatic Weapons of More Than Caliber 4.5 mm and a bullet flight speed of more than 100 meters per second, trade in non-military firearms and ammunition therefor, cold weapons, pneumatic weapons of caliber over 4.5 millimeters, and bullet flight speed of more than 100 meters per second; production of special devices charged with tear and irritant substances, personal protection, active defense and their sale” (hereinafter — draft resolution), published on September 23, 2020 in the subheading “Draft regulations” briefs “Normative base of the Ministry of Internal Affairs” of the official website of the Ministry of Internal Affairs of Ukraine: here.

The implementation of the draft resolution will apply to economic entities that carry out activities in the territory of the state for the production, repair, trade in non-military firearms, ammunition for it, special means.

Possible consequences of the implementation of the draft resolution for business entities and interested parties are to bring the by-law regulatory act into line with the requirements of the legislation governing relations in the field of licensing, namely:

• the list of documents attached to the application for obtaining a license is supplemented with information on the availability of places of economic activity for low-mobility groups of the population and the type of products to be produced (weapons, ammunition for it, special means);
• a new form and content of the notice of opening the place of business activity is established;
• The license conditions are supplemented by new applications, which establish the content and form of applications for license renewal, suspension of the license in full or in part, renewal of the license in full or in part, expansion of the procedure of the type of business activity by the licensee and narrowing the conduct of the type of business activity by the licensee, cancellation of the license censuses.

In order to ensure the clarity and transparency of the requirements of the License Terms, as well as to exclude the possibility of their subjective application by the licensing authority or licensees, the draft resolution clearly delineates the requirements for the storage of weapons, ammunition for it, special equipment in the trading hall and the room for their storage, and defines the procedure of action of the business entity in case of complete or partial suspension of the license.
