On leaving without consideration of the application for obtaining a license

The Ministry of Internal Affairs of Ukraine with applications for obtaining licenses for conducting business activities was applied by limited liability companies “TACTIC PRO” and “MILITARY ARMY MARKET” (hereinafter — license applicants).

In accordance with the fifth part of Article 10 of the Law of Ukraine “On Licensing of Business Activities”, the documents drawn up by the license applicant, the licensee in accordance with this Law, must be prepared in the state language and signed by the license applicant, the licensee or another authorized person.

However, applications for obtaining licenses are not signed by the heads of license applicants themselves, but by means of a facsimile, which makes it impossible to establish the expression of the true will of the person whose signature has been reproduced for the occurrence of relevant legal consequences, and is the reason for leaving them without consideration.

It is possible to eliminate this deficiency by signing applications for obtaining a license personally by the heads of license applicants.

In accordance with paragraph 2 of part 2 of Article 12 of the Law of Ukraine “On Licensing of Business Activities”

I ORDER:

1. Leave without consideration:

application dated 02.12.2020 № 765-2020 OF LIMITED LIABILITY COMPANY “TACTIC PRO” (identification code 32375465; location: 40th anniversary of October Avenue, house 100/2, Kyiv city, 03127) on obtaining a license to conduct business activities for the production of special personal protective equipment;

application dated 02.12.2020 № 764-2020 OF LIMITED LIABILITY COMPANY “MILITARY ARMY MARKET” (identification code 42676502; location: Soborna street, house 104, Irpin city, Kyiv region, 08205) on obtaining a license to conduct business activities in the trade of non-military firearms, ammunition for it, cold weapons, pneumatic weapons with a caliber of more than 4.5 millimeters and a bullet flight speed of more than 100 meters per second; sale of special equipment loaded with tear and irritant substances, personal protection, active defense.

2. Department of Communications (Shevchenko A.) to ensure that the order is posted on the official website of the Ministry of Internal Affairs for publication no later than the working day following the day of adoption of this decision.

3. Licensing Administration (Kamyshanov V.) to ensure control over the execution of this order.
