On leaving applications for obtaining licenses for the conduct of security activities without consideration

The Ministry of Internal Affairs of Ukraine with applications for obtaining licenses for conducting security activities was applied by limited liability companies “SEMPER SECURITY SERVICES” and “DEFENS LEGION” (hereinafter - license applicants).

Based on the results of the consideration of applications, it was established that there are grounds for leaving them without consideration, namely the submission of not in full the documents attached to the application for obtaining licenses.

Thus, applications for obtaining licenses do not comply with Appendix No. 1 of the License Conditions for the Conduct of Security Activities, approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 18, 2015 No. 960 (hereinafter referred to as the License Terms).

In addition, license applicants did not provide information about the availability of special means (Appendix No. 2 ¹), about the availability of response vehicles (Appendix No. 2 2), and DEFFENS LEGION LLC also Annex No. ^{2 regarding security} personnel.

In violation of paragraph 6 of the License Terms, DEFFENS LEGION LLC did not provide a copy of the document confirming the compliance of Deputy Director Mykhailenko Oleg Stanislavovich with the qualification requirements specified in clause 14 of the License Terms, as well as copies of the documents issued in the established procedures confirming his passage of a mandatory preliminary (periodic) psychiatric examination, a preventive drug examination and the absence of health restrictions for the performance of functional duties.

It is possible to eliminate these shortcomings by submitting applications of the established form (Appendix No. 1), Appendices No. 2, No. 2 1, No. 2 2 and copies of the above-mentioned documents in ^relation to the Deputy Director of ^LLC “DEFENS LEGION” Mykhailenko O. S.

In view of the foregoing and in accordance with paragraph 1 of part 2 of Article 12 of the Law of Ukraine “On Licensing of Business Activities”

I ORDER:

1. Leave without consideration:

application dated October 15, 2020 No. 655-2020 for obtaining a license to conduct security activities of SEMPER SECURITY SERVICES LIMITED LIABILITY COMPANY (place of residence: Kudryavsky Uzviz Street, house 5 B, room 320, Kyiv, 04053, identification code 43724525);

application dated October 12, 2020 No. 648-2020 for obtaining a license for the conduct of security activities of the LIMITED LIABILITY COMPANY “DEFENSE LEGION” (place of residence: Bogdan Khmelnytsky street, house 48, office 3, city Pereyaslav, Kyiv region, 08400, identification code 43763302).

2. Department of Communications (Shevchenko A.) to ensure the posting of this order on the official website of the Ministry of Internal Affairs for the publication of the working day decision on the next day.

3. Licensing Administration (Kamyshanov V.) to ensure control over the execution of this order.
