On the abandonment of applications for obtaining licenses for the conduct of security activities without consideration

The Ministry of Internal Affairs of Ukraine with applications for obtaining licenses for conducting business activities was applied by limited liability companies “SHERIFF — REMOTE 032”, “SHERIFF — REMOTE 033”, “SHERIFF — REMOTE 034”, “SHERIFF — REMOTE 035”, “SHERIFF — REMOTE 035”, “SHERIFF — REMOTE 036” (hereinafter referred to as license applicants).

In accordance with the fifth part of Article 10 of the Law of Ukraine “On Licensing of Business Activities”, the documents drawn up by the license applicant, the licensee in accordance with this Law, must be prepared in the state language and signed by the license applicant, the licensee or another authorized person.

However, applications and documents submitted for obtaining licenses in accordance with the requirements of the License Terms, approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 18, 2015 No. 960, are not signed by the heads of license applicants, but by means of a facsimile, which makes it impossible to establish the expression of the true will of the person whose the signature is reproduced, upon the occurrence of the relevant legal consequences, and is the basis for leaving them without consideration.

^{It is possible to eliminate these shortcomings by signing personally by the head of license applicants applications for obtaining a license, annexes No. 2, 2 1, 2 2 and certifying extracts from the work book of a person who is a specialist in organizing security measures.}

In accordance with paragraph 2 of part 2 of Article 12 of the Law of Ukraine “On licensing of economic activities”

I ORDER:

1. Leave without consideration:

application dated 04.01.2021 № 3-2021 for obtaining a license for the conduct of security activities of the LIMITED LIABILITY COMPANY “SHERIFF — REMOTE 032” (identification code 44050459; location: Nova street, house 1, office 1, village Hnidyn, Boryspil district, Kyiv region, 08340);

application dated 04.01.2021 № 4-2021 for obtaining a license for the conduct of security activities of the LIMITED LIABILITY COMPANY “SHERIFF — REMOTE 033” (identification code 43999547; location: Nova street, house 1, office 1, village Hnidyn, Boryspil district, Kyiv region, 08340);

application dated 04.01.2021 № 5-2021 for obtaining a license for the conduct of security activities of the LIMITED LIABILITY COMPANY “SHERIFF — REMOTE 034” (identification code 43914526; location: Nova street, house 1, office 1, village Hnidyn, Boryspil district, Kyiv region, 08340);

application dated 31.12.2020 No. 819-2020 for obtaining a license to conduct security activities of the LIMITED LIABILITY COMPANY “SHERIFF — REMOTE 035” (identification code 44025443; location: Nova street, building 1, office 1, village Hnidyn, Boryspil district, Kyiv region, 08340);

application dated 04.01.2021 № 6-2021 on obtaining a license for the conduct of security activities of the LIMITED LIABILITY COMPANY “SHERIFF — REMOTE 036” (identification code 44001490; location: Nova street, house 1, office 1, village Hnidyn, Boryspil district, Kyiv region, 08340).

2. Department of Communications (Shevchenko A.) to ensure that the order is posted on the official website of the Ministry of Internal Affairs for publication no later than the working day following the day of adoption of this decision.

3. Licensing Administration (Kamyshanov V.) to ensure control over the execution of this order.
