On leaving without consideration of the application for obtaining a license

The Ministry of Internal Affairs of Ukraine with application No. 719-2020 dated 09.11.2020 about obtaining a license for conducting business activities for the production of personal protective equipment was applied for the second time by the Representation of “ECCENTRICity INVEST S.R.O.” (hereinafter referred to as the Representative Office).

However, by the order of the Ministry of Internal Affairs of Ukraine dated October 12, 2020 No. 720, the application of the Delegation dated 03.09.2020 No. 570-2020 on obtaining a license for conducting business activities for the production of personal protective equipment was left without consideration, due to the fact that the Representation did not obtain the status of a legal entity.

In accordance with Article 80 of the Civil Code of Ukraine, a legal entity is an organization established and registered in accordance with the procedure established by law.

The Law of Ukraine “On State Registration of Legal Entities, Individual Entrepreneurs and Public Organizations” stipulates that state registration of legal entities is official recognition by state certification of the fact of creation or termination of a legal entity, changes in the information contained in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations on a legal entity (hereinafter referred to as the Unified State Register), as well as other registration actions provided for by this Law.

At the same time, the Unified State Register does not have any information under the identification code 26633949 specified by the Delegation in the application No. 719-2020 dated 09.11.2020.

It is possible to eliminate this deficiency by acquiring the status of a legal entity by the license applicant in the manner prescribed by law.

In accordance with paragraph 4 of part 2 of Article 12 of the Law of Ukraine “On licensing of economic activities”

I ORDER:

1. Leave without consideration the application dated 09.11.2020 № 719-2020 of the Representative Office of “EccentriCity INVEST s.r.o.” (location: Varvara Dovzhenko street, building 86-A, Demidiv village, Vyshhorod district, Kyiv region, 07335,) to obtain a license for conducting business activities for the production of personal protective equipment.

2. Department of Communications (Shevchenko A.) to ensure that the order is posted on the official website of the Ministry of Internal Affairs for publication no later than the working day following the day of adoption of this decision.

3. Licensing Administration (Kamyshanov V.) to ensure control over the execution of this order.
