On leaving without consideration of the application for obtaining a license

The Ministry of Internal Affairs of Ukraine with an application dated 06.01.2020 № 1235 about obtaining a license for conducting business activities for the production of personal protective equipment was applied for the third time by the Representative Office of “ECCENTRICity INVEST S.R.O.” (hereinafter referred to as the Representative Office).

During the consideration of the application for obtaining a license, it was established that there are grounds for leaving it without consideration, since in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations there is no information under the identification code 26633949 specified by the Delegation in the application.

In accordance with the first part of Article 80 of the Civil Code of Ukraine, a legal entity is an organization established and registered in accordance with the procedure established by law, and according to the fourth part of Article 87 of this Code, a legal entity is considered to be established from the date of its state registration.

Relations arising in the sphere of state registration of legal entities are regulated by the Law of Ukraine “On State Registration of Legal Entities, Individual Entrepreneurs and Public Organizations”, which defines that state registration of legal entities is an official recognition by state certification of the fact of creation or termination of a legal entity, changes in the information contained in the Unified State Register, on a legal entity, as well as carrying out other registration actions provided for by this Law.

At the same time, in connection with the failure of the Representation to obtain the status of a legal entity by the orders of the Ministry of Internal Affairs of Ukraine No. 720 of October 12, 2020 and No. 808 of November 13, 2020, applications from 03.09.2020 No. 570-2020 and from 09.11.2020 No. 719-2020 about obtaining a license for conducting business activities for the production of personal protective equipment were left without Consideration

Considering that the Representation has not acquired the status of a legal entity and in accordance with paragraph 4 of part 2 of Article 12 of the Law of Ukraine “On Licensing of Business Activities”

I ORDER:

1. Leave without consideration the application dated 06.01.2021 № 1235 of the Representative Office of “EccentriCity INVEST s.r.o.” (location: Varvara Dovzhenko street, building 86-A, Demidiv village, Vyshhorod district, Kyiv region, 07335) about obtaining a license for conducting business activities for the production of personal protective equipment.

2. Department of Communications (Shevchenko A.) to ensure that the order is posted on the official website of the Ministry of Internal Affairs for publication no later than the working day following the day of adoption of this decision.

3. Licensing Administration (Kamyshanov V.) to ensure control over the execution of this order.
