On leaving applications for obtaining licenses for the conduct of security activities without consideration

The Ministry of Internal Affairs of Ukraine with applications for obtaining licenses for the conduct of security activities was applied by the limited liability companies “MODERN SECURITY SERVICE”, “FORT SECURITY” and “SECURITY AGENCY “FORCE” (hereinafter - license applicants).

Based on the results of the consideration of applications, it was established that there are grounds for leaving them without consideration, namely the submission of not in full the documents attached to the application for obtaining licenses.

Thus, in violation of paragraph 6 of the License Conditions for the Conduct of Security Activities, approved by the Resolution of the Cabinet of Ministers of Ukraine No. 960 of November 18, 2015 (hereinafter — License Terms), copies of documents confirming compliance with the qualification requirements were not provided to the application for obtaining a license of LLC “MODERN SECURITY SERVICE”, defined in clause 14 of the License Terms, the Deputy Director of Kiporenko Yevhen Valeriyevich, as well as his passing of a mandatory preliminary (periodic) psychiatric examination, preventive drug examination and lack of health restrictions for the performance of functional duties.

To confirm compliance with the qualification requirements of Deputy Directors Osychnyuk Anatoly Stepanovich and Primak Oleg Vasilyevich, Oleg Vasilyevich, LLC “FORT SECURITY” LLC and LLC “SECURITY AGENCY “FORCE” were not sent copies of their diplomas of higher education.

In addition, in subsection 1 of paragraph 9.4 of section 9 copies of employment contracts concluded by license applicants with hired employees who are entrusted with the performance of the duties of a specialist in organizing security measures, the name of the employer does not correspond to the name of the license applicants.

It is possible to eliminate these shortcomings by providing the above-mentioned copies of the documents in relation to the deputy directors of license applicants and making appropriate amendments to the employment contracts.

In view of the foregoing and in accordance with paragraph 1 of part 2 of Article 12 of the Law of Ukraine “On Licensing of Business Activities”

I ORDER:

1. Leave without consideration:

application dated October 27, 2020 No. 693-2020 for obtaining a license for the conduct of security activities of the COMPANY WITH LIMITED LIABILITY “MODERN SECURITY SERVICE” (location: Zoologichnaya Street, house 4 A, office 139, Kyiv city, 04119, identification code 43108832);

application dated October 27, 2020 No. 695-2020 for obtaining a license to conduct security activities of the LIMITED LIABILITY COMPANY “FORT SECURITY” (location: Zoologichnaya Street, house 4 A, office 139, Kyiv city, 04119, identification code 43748813);

application dated October 29, 2020 No. 700-2020 for obtaining a license to conduct security activities of the COMPANY WITH LIMITED LIABILITY “SECURITY AGENCY “FORCE” (location: Shepeleva Street, building 6, Kyiv city, 03061, identification code 43749136).

2. Department of Communications (Shevchenko A.) to ensure the posting of this order on the official website of the Ministry of Internal Affairs for the publication of the working day decision on the next day.

3. Licensing Administration (Kamyshanov V.) to ensure control over the execution of this order.
