On refusal to issue a license
on the conduct of security
activity
The Ministry of Internal Affairs applied to the Ministry of Internal Affairs for the issuance of a license to conduct security activities by the limited liability company “LEGAL COMPANY “PRAVOVA POMORGA” (hereinafter — the license applicant). According to the results of consideration of the application and documents submitted by the license applicant, it is established that in violation of the requirements of paragraph eight of the first part of Article 1 and paragraph 2 of Article 11 of the Law of Ukraine “On Security Activities”, the specialist in organizing security measures is not the head of the security entity or his deputy, the head of the branch, other of a separate structural unit or its deputy, whose official duties include the organization and conduct of security measures, control over the performance by the security personnel of the duties assigned to it .
At the same time, the requirements for a specialist, defined in paragraphs 6 and 14 of the License Conditions for the Conduct of Security Activities, approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 18, 2015 No. 960, were violated, namely:
work experience in officer positions in operational and investigative units of internal affairs, security police, SBU is less than three years;
available higher education and work experience of more than three years in managerial positions (director, deputy director, head of a branch, other separate division), as well as higher legal education and experience of more than three years in the specialty in enterprises that are not subjects of security activities.
To the application for obtaining a license, the head of the company must attach a copy of the passport of a citizen of Ukraine.
It is possible to eliminate these shortcomings by providing documents on the manager and a specialist in the organization of protection measures that will meet the above requirements of the legislation.
In accordance with the requirements of paragraph 1 of the third article 13 of the Law of Ukraine “On licensing of economic activities”
I ORDER:
1. Refuse to issue a license to conduct security activities to the limited liability company “LEGAL COMPANY “PRAVOVA POMORGA” (identification code 36577585, location: Yakira Street, house 13, Kyiv city, 04119 — application dated March 23, 2017 № 105—2017).
2. Department of Communications (Shevchenko A.V.) to ensure the posting of this order on the official website of the Ministry of Internal Affairs for the publication of the working day decision on the next day.
3. The licensing department (Kamyshanov V.I.) to ensure control over the execution of this order.
