According to Article 5 of the Law of Ukraine "On the status of military service veterans, veterans of internal affairs bodies and certain other persons and their social protection" (hereinafter - the Law), veterans, in particular internal affairs bodies, are citizens of Ukraine:
persons with disabilities of groups I and II, whose disability occurred as a result of injury, contusion, mutilation or illness related to the performance of military service, service in the military reserve during direct participation in the anti-terrorist operation, in the implementation of measures to ensure national security and defense, repulse and deterrence of the armed aggression of the Russian Federation in Donetsk and Luhansk regions, being directly in the districts and during the implementation of these measures, or in the performance of official duties to protect public order, fight crime and eliminate the consequences of emergencies;
The organization of work on registration of documents for granting the corresponding status is defined by the Instruction on the organization of work on registration of documents for appointment (recalculation) of pensions according to the Law of Ukraine "About pension provision of the persons discharged from military service and some other persons" and on other social questions by the order of the Ministry of Internal Affairs of Ukraine № 760 dated September 17, 2018 (hereinafter - the Instruction).
Issuance of certificates and badge "Veteran of Internal Affairs", which confirms the status of a veteran and his right to receive benefits in accordance with the Law, other legislation, is carried out by the Department of Coordination of Pensions and Social and Humanitarian Affairs.
The law stipulates that veterans of internal affairs bodies are persons subject to the following factors: citizenship of Ukraine; impeccable service; 25 and more years of service in the calendar or 30 or more years in the preferential calculation (of which at least 20 years is the service in the calendar calculation); establishment of disability of the I and II groups which has arisen owing to the illness received during the period of military service and service in law-enforcement bodies and existence of service of 20 years and more; dismissal to reserve or resignation in accordance with the law.
Article 5 of the Law clearly provides for 20 years of military service and service in the internal affairs bodies and does not contain exceptions in this case.
Studying in civilian higher education institutions is a period of time, but not a type of service, the periods of which are taken into account for granting the status of "Veteran of Internal Affairs".
Widows (widowers) of deceased (deceased) military service veterans, veterans of internal affairs bodies and members of their families who are dependent on them, enjoy the benefits provided for in paragraphs 6 - 9 of Article 6 of the Law. In order to exercise the rights of this category, the department issues the relevant certificates.
